ash cashin' saying if we start to see that creep closer to 2.7% we might see fresh selling come into the market. stocks remain near record highs a new king in the mutual fund industry. pimco's bond fund no longer number one. dominic chu is back at hq with that. hi. >> hey, sue. it's been years in the making but bank art has unseated pimco at the top of the mutual fund heap. not just about vanguard versus pimco but stocks versus bonds. the vanguard index fund had more assets than the previous title holder, of course, pimco's total return bond fund. now vanguard's fund invests in stocks across all market caps and styles from value to growth. it's got over 3600 individual stocks in the portfolio. now the most heavily weighted sectors in the fund are technology, financials and industrials. that mirrors the way the s&p 500 is set up, although the fund favors industrials slightly more than the overall stock market. and as for the biggest holdings, perhaps no surprise here. the biggest holdings so far in the fund according to vanguard is apple, of course. that's followed by exxon mobil, the

. >> bob, you and art cashin and i have talked about this a lot, traditional metrics overbought, oversold, have been thrown out the window. i don't want to sound like i'm whistling past the graveyard, but this is reality right now. >> these overbought indicators have been around for a long time and overbought for a long time. the best hope for the shorts this year is the fact that all the short funds are closing. remember when julian robertson threw in the towel in 2000, closed tiger down. he wasn't a short but he said, i don't understand it anymore. that was essentially the top of the market. very pressing comments he had there. i think that's a good sign. number two, the thing i would agree on the shorts is that as the fed ends the quantitative easing programs, that there will be alpha opportunities around that and i think a lot of money can be made in picking the right names. massive shorts, i don't think so overall. i don't just mean chinese internet names. those are easy picks. i think there are alpha opportunities out there. >> brad, what are your top stocks you're shorting right no

art cashin this morning. simon? >> mcdonald's out with october sales number this morning showing same-store sales growth remains sluggish off u.s. and europe, upsetting sales in europe. jeffrey has a buy rating. good morning. >> good morning. >> jeffrey, is that your rating or would you have a more beat spin on it? >> it's hard to get too upbeat. the comps were relatively flattish. that's where they were two weeks ago, it came in a little bit above that. the challenges are prevalent across the u.s. and europe, most of the world. >> why are you sticking to $108 as a price target? >> the benefit that mcdonald's has at this point, being the largest player, this can get a little more aggressive in terms of promotion and value. they were on a very strong eight, nine-year run. they do now have favorable comparisons to go up against and we still view it as kind of a defensive play and more challenging bamack macro. >> is it a more chipotle issue? >> whether it be wendy's in quick service who seems to be doing better or chi

art cashin at ubs talked about there being resistance level at 1802 on the s&p 500. we did a note from jpmorgan tom levy, equity strategist, who has an eight steen 25 target by end of the-year 1825. yellen, santa clause rally, we'll see. back to you. ashley: nicole, thanks very much. sandra, any commodity reaction as the equity markets hit record territory? >> absolutely. the money is chasing the stock market. what happens then, ashley? investors sell out of other assets like gold and silver. both are down as u.s. dollars flow out of those metals into the equity market. right now gold prices suffering the biggest drop in about a week. we're looking at gold down $14 at 1273 a troy ounce. silver is down even bigger than gold on percentage basis, down 1 1/2%. $20.40 an ounce. in addition to money flowing out of the assets into the stock market, they're watching a lot of fed speak. we have a couple of fed speakers today. ben bernanke tomorrow evening. we have jobless claims on thursday. the markets will all watching all this, as that happens, guys, oil prices were down.

art cashin was explaining that to be key resistance as we come back down. we're expecting a settlement between jpmorgan and the justice department. >> what we're likely to get is very well telegraphed to the press. it been a long negotiation. from what you've seen in the press, and i'm thinking particularly of the inclusion of consumer aid around $4 billion, what do you make of what we're likely to hear in the next few minutes? >> well, i think you're going to see that -- look, i think the most important thing here is jpmorgan is working through its problems and this is one of its larger problems. it still has a lot of other ones it has to work itself through. it's taking an important step here. it's a record fine but a lot of the money will go to help homeowners. i think you'll see renegotiation of mortgages out there so homeowners will get relief. i know you'll be running a program about some of america's blighted cities. i think you'll see relief to cities like detroit and others that are really hurting financially, the homeowners are hurting, consumers
