undefeated number one ranked florida state seminoles. jameis winston was accused of sexual assault stemming from an incident a year ago. now, he's the leading contender for this year's heisman trophy. a warrant just released today shows the rape allegation against him followed a night of drinking at a bar, all before he was the starting player, or even started playing for the team. he had been red shirted that year. a former classmate at florida state filed her sexual assault complaint on december 7th of 2012. she did not identify winston to police until a month later. in november winston finally provided a dna swab which reportedly matched dna from the scene of the alleged attack. winston's attorney says the sex was con sen chul. the accuser's family said last month that a tallahassee detective told her attorney that tallahassee is, quote, a big football town and her client's life could, quote, be made miserable if she pursued a sexual assault case against winston. joining me now, the sports editor at the nation and former u.s. attorney

steve is live for news south florida. do we know what was missing in the case and why they couldn't go forward? >> the state attorney gave several reasons. saying he had a case he thought would fall apart on the stand. no real overwhelming physical evidence of violence or of a witness who could come forward and say i saw a sexual assault happen. the other problem with the accuser, the 19-year-old woman, a student who left the university. problems with her memory. and finally, perhaps the biggs hurdling something the state attorney said would get them eaten alive in the courtroom, the presence of multiple dna on the accuser. sex with more than one man at that time. >> there was dna from males, one was identified as being winston's dna, and the other one was unknown. and obviously if we were going to proceed to trial, having an unknown dna in a sexual assault kit, would be a problem. so we had to make every effort to determine the donor of that dna. and did so. >> they did identify the donor of the dna. he was the boyfriend
