earlier, i spoke with new york congressman peter king about the death of this u.s. citizen this week and the latest on the investigation into that benghazi massacre last year. congressman, thanks for being with us. can you tell us what we've learned well over a year later into what happened that night? >> yeah. without going into details or what was given behind closed doors, the reality is that everything we learned about benghazi since september 11th, 2012, is that the administration did not tell the truth, intentionally -- i believe intentionally misled the american people from the start. this was never a demonstration involving a video. this was a coordinated terrorist attack led by al sharia, an al qaeda offshoot in the benghazi area of libya. there were very sophisticated tactical moves. unfortunately, this was first-rate mortar ability where al qaeda had been carrying out attacks over the summer and ambassador stevens went into that area with minimal security. the attack was carried out,cont. no justification given why military assets were not closer by, why

joining us now, republican congressman peter king of new york, who has already indicated he's running for president potentially in 2016. we'll talk about politics in a little while but let's talk about sanctions first, congressman. what do you think, these senators, democrats and republicans, they say that if there's no deal, if it doesn't work out, they are going to give the president in effect a year to reach an agreement, but if iran cheats, doesn't do the deal, then they are going to tighten the sanctions. i assume you would vote for this, right? >> wolf, absolutely i would definitely support these sanctions. the fact is that if iran is serious about the agreement, they should have no problem with the sanctions, because the sanctions only kick in if they don't comply with the agreement. secondly, the president should want these sanctions as a weapon to hold over the iranians so i don't see why the president is so opposed to these sanctions. i don't understand why the iranians, i can understand why they say they're opposed but if they're serious about this agreement they should be

michael, take a listen to peter king. >> we need the nsa to remain -- as i said, no abuses by the nsa. the president has said that. this is all to me a debate, generated by the hysteria caused by edward snowden and why we're listening to him is beyond me. >> he says there is no abuse. that's not really true, though, is it? >> well, it really depends on what your definition of abuse is, ari. by abuse, there was no systemic violation of the rules set for nsa. doesn't mean there were none. there were. the examples you have. but those weren't broad. the real disagreement is whether what the guysa court, foreign intelligence court and what two presidents asked the nsa to do, whether or not that -- what they were supposed to do violated people's privacy. now, we have disagreements on both sides of that. you have judge leon in the district court of dc saying yes. you have had 15 fisa court judges say no. so what is going to play out here is what is our definition of what privacy should be and what spying should be. >> yeah. i mean, let's take a look at some examples. the nsa reportedly, acco

joining me now to talk about this, republican congressman peter king of new york. he serves on the homeland security and intelligence committees. congressman, what do you think the ultimate result is here? do you think this will be settled by the supreme court? >> first of all, i would like to say that i fully agree with the decision that the nsa's actions are entirely constitutional. having said that, i think this case is going to go to the second circuit court of appeals. judge leon's decision or ruling is going to go to the district of columbia court of appeals. i think again, i have no way of predicting how that's going to go but this certainly seems like the type of case that is going to end up in the u.s. supreme court, because it does -- it is of paramount national interest and it is obviously conflict and that conflict may show itself again at the u.s. court of appeals level. >> congressman, this all started back with edward snowden. we've heard from him recently in an interview with the "washington post." he said mission accomplished. partially because he

peter king, the congressman from new york, saying it is a victory and adding that it preserves a vital weapon or the united states in our war against international terrorism. bottom line, a big win here for the government and the nsa, but just one in a much larger legal fight to come. >> for those who have not followed it as closely as the washington insiders, what can you tell us about the obama administration, what it has been telling us about how it has been reviewing everything right now? >> you have three different tracks -- the legal track playing out as we see in this courtroom in new york and ultimately likely headed to the supreme court. then, the ad -- the administration itself. president obama said he would conduct his own review of these surveillance programs. he had a panel of experts give him advice last week and said in his press conference he will come out with his own proposed changes in january. watch for that perhaps is the next big step. congress is also considering changes. lawmakers, including many from the president's party, are prepared to make much more substan

i just spoke to peter king on the telephone just a little while ago. he said he has no doubt that this thing is destined for the supreme court. >> this is breaking news a couple of hours ago, and as this information was coming in, one question that popped up. why does it matter what the federal judge in new york says about the nsa? can't the nsa just operate the way it wants regardless of the ruling. >> it cannot act the way it wants. it has to abide by the fourth amendment which is against unlawful searches and seizures. the other judge's decision said i cannot imagine a more increment senate and arbitrary invasion than the systemic high-tech collection of data on virtually every single citizen for purposes of clearing and analyzing it without prior judicial aapproval. the plaintiff said this at the time of the ruling. >> the breach of constitutional rights is so gross here. never in the american history have we seen a police state implemented by our government, where everything we say, every we send by e-mail, anything we look at on social media, is
