let's check traffic with elizabeth. >> things are great so far out towards the bay bridge. it's one of our only spots where we can find some overnight roadwork. a lot of folks continuing their new year's holiday. the caltrans workers, probably off until tomorrow. westbound 80 all the approaches to the bay bridge so far moving at the speed limit but there's some roadwork from the incline towards yerba buena island. here's the nimitz freeway. 880, nice and light. extra light northbound past the coliseum, oakland airport, toward your downtown oakland exits. even westbound 580 starting to get a little crowded as you can see there towards the dublin interchange. but the drive time is still in the green category in the clean, 14 minutes between the altamont pass and the dublin interchange and 680. other drive times obviously still "holiday light" traffic out there on the nimitz and the eastshore freeway, all still moving at the speed limit. bart is also on time. they are back to a regular schedule today, by the way, so they have more than 20 trains and they are all on time. that

and, elizabeth, i'll bring you in on that. if you don't trust the government with this information, would you trust a phone carrier who may not and certainly there's questions of regarding how contractors and who has access to what. but when it goes into the hands of a private company. these issues don't dissipate. the concerns of your privacy must still exist. >> they do still exist for sure. but it's important to understand that the telephone companies hold this data. this is their billing records. they do hold it under existing regulations. they actually have to hold it for 18 months. so if the president were to end bulk collection tomorrow, the telephone companies would still have this data in their possession for 18 months. so that's a bit of a straw man. the question is whether the president is going to pursue some kind of legislation to require the telephone companies to hold it for longer or in a different format. in which case, they then become not service providers but agents of the intelligence establishment. and th

elizabeth, you have to keep the details of the case secret. but what do you think that the likelihood is that the government will -- >> the question was that the likelihood that the judgment will set a precedent? >> i think it's very likely. this case has already set two precedents in the 9th circuit court of appeals, and assuming there's another appeal, i think it will be a third groundbreaking decision. and this hopefully will pave the way for other people to contest their placement on these lists and force the government to take a really hard work at what it's doing, depriving it's citizens of fundamental rights. >> how is that with the process that you take your clients through? >> it's the courts pushing back against the government that the no-fly list is crucial to our safety. so by actually ordering the removal of someone off of the no-fly list, that's an example that our judge in hav virginia,r judges in oregon, can look to on these no-fly lists and see that, and there's a role that the judiciary can play in these awful practices. >> d
