chris gordon is in gaithersburg tonight with a story. chris? >> good evening. we begin with brand-new information. montgomery county police tell me that the driver of the van that crashed into this store front has been charged. he's identified at 92-year-old edward roberts of montgomery county. he faces charges of negligent driving and failure to control speed to avoid a collision. two people were injured in this crash. >> i don't know. i'm just still shaken. still shaken. >> reporter: as she looks back at the damage to the store, she realizes the minivan was heading right toward her. >> i wasn't hurt. mentally, maybe. emotionally. but not physically. i was coming out of the fitting room, walking towards the women's section, where the van is currently positioned. >> reporter: the minivan crashed through the glass door and window just as two women, one carrying an infant, were entering the store. a store employee showed investigators the video from surveillance cameras inside, and then told me -- >> after looking at the video again, she came about that close fro

chris gordon is in maryland with more on the new governor. we begin with northern virginia bureau chief in fairfax county, where they're double-checking the biggest single block of votes for errors. >> reporter: fairfax county was responsible for 300,000 votes. inside today election volunteers are pouring over those results, doing the math and looking for errors, a process playing out in all the cities and counties in virginia. when it's completed, it's something ed gillespie will use to decide whether or not to seek a recount. >> reporter: canvassing the vote, it's a painstaking process that happens after every election but the intensity spikes when it's close. armed security guards were posted overnight until the tapes could be unsealed. >> to make sure there were no transcription errors or math errors and we try to get the numbers as right as possible. that's what we are going to do. >> reporter: already hundreds of votes have shifted and mark warner has an elections lawyer who insists the difference is too big for gillespie to overcome. >

news 4 chris gordon is live outside the u.s. district courthouse with new information about the agent involved. chris? >> reporter: good evening. all because of fbi at matthew lowry, investigated for alleged misconduct. he has been suspended from the fbi. he's 33 years of age and allegedly tampered with drug and gun evidence compromising dozens of cases. today the anne arundel county police department confirmed for me that he is the son of their assistant police chief. they add, this is a personal issue that the family is dealing with. sources tell me that fbi agent matthew lauerry stole drugs in an evidence locker, part of a criminal investigation for his personal use and possible sale, found passed out in his car in southeast washington a few weeks ago with some of that drug evidence in his possession. as a result of lowrys alleged misconduct, d.c. prosecutors identified 28 criminal cases that they are moving to dismiss. here at the federal courthouse in d.c. this afternoon, cases against ten defendants were dismissed by judge

chris gordon talked to some of the victims' family members today and joins us live from the scene. chris? >> reporter: these were young adults who had jobs and dreams for the future. but tonight their families are dealing with a tragedy of their deaths. >> that's my only daughter. i don't have anymore. so it's hard for me. >> reporter: he shared a picture of his 24-year-old daughter, melissa. saturday night after working in a phone store, she told her family she was too tired to go out, but friends insisted she accompany them to a birthday party in bethesda. >> i cannot imagine my sister in the state she had the accident. i just remember the cheerful person she was all of the time. >> reporter: 21-year-old caesar noriega, formerly worked with melissa. he wanted to start his own business. >> lovely guy, smiling all of the time, happy. >> reporter: the third victim who died at the crash was 23-year-old yenny vincent de leon. this trail along east-west highway is the scene of the crash. there are flowers, candles and some of the wreckage. friends posted on instagram, i'm sorry you had

and as news4's chris gordon reports, that has the school board thinking about changes for next year. >> good afternoon from julius west middle school. the montgomery county board of education tomorrow votes on its new school calendar for the year 2015 and 2016 and may at that time eliminate all references to the jewish high holidays of rosh shanna and yom kippur. since the public school system in montgomery county does not close for the muslim holiday, one of the alternatives is to eliminate references to rosh shanna and yom kippur and just list those days on the calendar as no school days. >> one option would be leaving it the way it is right now and one of the options would be to not mention the holidays by nam but still the schools would be closed. so the actual impact on the calendar is really negligible. there is no impact on the calendar. we would still be closed on those days. it's just how we label them on the calendar. >> reporter: all new at 5:00, muslim groups who want their holiday added to the school calend calendar. that's at news4 at 5:00. >>> do you think montgomery c

chris gordon is live at the loudoun county courthouse with more on how the charges are already affecting smoot's new career. >> reporter: well, this case is very difficult on both sides. it comes at a time with allegations swirling around the nfl, the university of virginia and bill cosby. in that context, valerie jackson of ashburn, virginia, has filed a very serious charge against fred smoot. fred smoot spent his football career on defense. now the former redskin is a defendant. i spoke with his lawyer, who says smoot denies the allegation, saying they come from a vindictive ex-girlfriend. >> we're confident the actions are going to show she has been the aggressor and the pro vok tour in these matters and it's extremely unfortunate she is engaging in this personal campaign in an effort to ruin him both personally and professionally. >> reporter: so we went to the woman who made the complaint. >> i am not ready to comment on camera. this is fresh and this is hard. i just came from a lawyer's office. and i feel safe behind this door and i don't feel safe in front of cameras or media. >>
