there are a lot of people who are going to push wheeler and the fcc to act. frankly at this point, i don't know. i think the pressure will be on wheeler and the president may make another statement that if he does not do anything by at least next spring. tom wheeler himself has said multiple times, i want to get this done and get on to other things. there is nothing funny -- a funny about net neutrality. you know how presidents come to office and say i don't want to do with the middle east, and and you are dealing with the middle east? in some ways, net neutrality is the middle east of telecom policy. i imagine trying to get this done in the spring. the second question is how litigation will affect it. there is nothing to litigate until the fcc actually does the rule. i would say that will be act two. we are still a knack for or act one and a half right now. >> would you explain how title ii would affect internet policy and how section 706 would affected as well? >> what a question. is the historic, most powerful authority that the agency has. it was part of

berkeley's wheeler hall. stephanie chuang joins us live from inside wheeler hope. you have to think they hope this action prompts reconsideration of the hikes. good morning. >> reporter: good morning to you, sam. that's the goal here, an estimate of maybe 100 or more students. some of camped out in classrooms sleeping together right now, many have been here since 5:00 last night. you look at the students, many of them are trying to get some rest here. at issue is the tuition rate hike that would take it up almost to $16,000 for tuition going into the 2019 school year. the school says it needs more money to hire professors but students say it's unfair to put it on them. nathan, you've been here the entire time. this connection to wheeler hall, you have one. there were protests in 2009 and your sister was there. >> a few years back, a number of grad students locked themselves in the building and my sister was outside the building forming a human chain against the police who were trying to remove the grad students. >> reporter: what prompted you to be here the entire

protesters at the berkeley campus have been occupying wheeler hall. they said they aren't leaving until regents withdraw the fee increase. stephanie chuang is heading to wheeler haul to talk to protesters this morning. she'll is a live report at 5:00 a.m. >> this is the third breach at the airport this year. this man made it to the tarmac. employees saw him, tried to detain him and call police but saragosa got away. >> if a guy can come in and steal like a maintenance vehicle, who knows what else they can do, bringing in weapons and what not. that can be kind of scary. >> just makes you wonder about the security, how could someone get that far on the on-ramp? >> a lot of questions to be answered this morning. authorities say there was never any threat to passengers. and as we mentioned, this marks the third security breach this year at sjc. muriel hartman was able to sneak past security without a ticket. she boarded a flight to los angeles and was arrested after she landed. she was also arrested when she was reported at sky harbor airport in phoenix.

comfortable that tom wheeler can say that i am glad of your input mr. president that but i have a different view. on the other hand it's difficult for the president. he is the head of the party in the head of the country. on the other hand wheeler could have people from congress telling them not to do with the president says which is very different and of course industry is never like this so it is frankly even by net neutrality standards and new area of chaos. what i predict is there will probably be a lot of efforts but you have to think the most likely outcome is it will delay things a little bit and frankly not to get too much in the weeds may get tangled up in the question of whether the administration is going to allow comcast to take over time warner which is a slightly different issue but i believe they will be tangled up now. >> host: how so? why would that be effective? >> guest: well the main, it's really not well with legal and political. the main subject of the net neutrality rules of course the cable and phone companies offering broadband

they walk across miles of desert in the summer heat or hide in the back of 18-wheelers to reach our country. this creates enormous pressure on our border that walls and patrols alone will not stop. to secure the border effective wely we must reduce the numbers of people trying to sneak across. therefore, i support a temporary worker program that would create a legal path for foreign workers to enter our country in an orderly way for a limited period of time. this program would match willing foreign workers with willing american employers for jobs americans are not doing. every worker who applies for the program would be required to pass criminal background checks. and temporary workers must return to their home country at the conclusion of their stay. a temporary worker program would meet the needs of our economy. and it would give honest immigrants a way to provide for their families while respecting the law. a temporary worker program would reduce the appeal of human smugglers and make it less likely that people would risk their lives to cross the border. it would ease the financial burde

we're in the main lobby of wheeler hall where the main protests have been here at u.c. berkeley. here it's pretty empty and quiet, a couple of police officers patrolling, lots of signs up. most of the protesters are inside the main lecture hall sleeping, 20 to 30 of them. a difference in the presence as when we were first here. they do have three demands, the primary one being that regents rescind that tuition hike they approved thursday of up to 5% for five years if the state does not provide more funding. >> the message is still there. it's that knowledge is not a commodity and is not a privilege, that people should be taken away from the public. >> reporter: things have been peaceful since last wednesday's board of regents meeting. in terms of the movement, there is thanksgiving break happening later this week, but students say even if they go home, they'll be right back here to continue this message. in terms of the walkout, that is planned at noon, which is statewide at various campuses. >> very interesting, it's a statewide response right now. thank you, stephanie. >> san f
