district attorney seth williams called the death of brandon tate brown a tragedy but not a crime and he detailed how he came to that conclusion, david henry is live now with the details. >> reporter: you may recall that the shooting of brandon tate brown happened during the racial unrest that erupted over the michael brown case and the eric garner case in new york but d.a. seth williams says that unlike in those cases the police acted properly here in this case. >> it was a tragedy but what occurred was not a crime. williams says that forensic and eyewitness testimony supports the police account of what happened when brandon tate brown did after being pulled over in his car. they spotted this gun wedged between the passenger seat and they ordered tate brown out of the car and he started to struggle with him and one of the officers shot him in the head when he tried to get the gun. >> he did not walk around or put his hands up instead he went around the other side and reached inside to the place where he put his gun. >> williams showed a grainy video of what appeared to be a struggle.
