it happened in pittsburgh. in 2013 the local paper broke a story that the police chief had a security company on the side that employed other officers. the chief was forced to resign and it opened a pandora's box of problems and misconduct around off-duty police work. steven is a criminal defense lawyer and consultant in pittsburgh. he was asked by the mayor to lead the independent review of the police department's off-duty policies. steven, good to see you. thank you for joining us. >> it's my pleasure. thanks for having me this evening. >> the former police chief nate harper's actions included misconduct and conflict of interest. what are the big revelations. >> the story unfolded in 2013. a local newspaper broke a story that the chief of police owned a private security company called diversified public security. the belief was that he had collaborated with a few officers and was providing security services and consulting services to private industry around the city of pittsburgh and throughout the region. at

in the city of pittsburgh, the chief directed a programme where off-duty officers were using pittsburgh police equipment. uniforms, insignia, badges, radios and vehicles in providing security. there was a charge. that was passed on to the contracting company, and at a rate of $4 per officer per hour. it was collecting a fee. those fees, the fbi determines, police. >> the important thing is someone may watch the show saying what has this got to do with me, i don't live in pittsburgh or salt lake city. pittsburgh paid $215,000 in legal settlements because of off-duty details. in 2011, the city spend a lot of money on workers comp, police making claims during off duty work. how often are taxpayers hit? >> you are right, the liability exposure is enormous. anything from injury to workers comp claims. civil right and judgments that follow can be devastating to the tax payers. it's not limit to pittsburgh, it's just one of many places that use the programmes. there has been a landmark case prior to pittsburgh featured in my report, that related to an investigation in the city of new orleans,

that's when pittsburgh loomed into view. in 2011, the university of pittsburgh and its renowned sister medical center offered an ideal career move. for bob, a new research lab. for autumn a chance to head her own department. >> autumn was not just a rising star, she was a shooting star. she was nationally recognized as a leader in her field at a very young age. >> reporter: but still something was gnawing at her, a kind of emotional vacuum. she wanted to have another child. by now in her early 40s, she was taking fertility treatments, hormone injections. but nothing was happening. was it really eating away at her that she wasn't getting pregnant, time was going by? >> yes. and, you know, just speaking from experience, fertility treatments are the loneliest place a woman will ever go. >> reporter: looking back, her mom, lois, recognizes now some worrisome signs. changes in her daughter. >> i kind of saw that she wasn't herself too much anymore, that she was kind of a little -- what do you call it -- kind of a little down, may

amy: that report from pittsburgh. steve downs, khalifah al-akili contacted you right before that arrest. now explain as we hear about fbi stings and arrests now, just in our headlines today, around the country, explain ultimately what he was convicted of. >> well, he was convicted -- the fbi, when they go after some of you like this, we call it preemptive prosecution. they look for anything they can get to take a person down if they are suspicious about his motivations or if there's something they think he might do in the future. so they apparently went through his records very closely, as they do in a lot of cases, and found he had a prior drug arrest -- felony drug arrest. a number of years ago, which would prohibit him from owning or possessing any guns. any firearms. on his facebook page, he had posted a picture of himself holding a gun which a friend had given him in a public shooting range. he was simply holding the gun. obviously, he did not think of that as possessing a gun. it was a gun at a been rented at th

lancaster, philadelphia and pittsburgh. all three refuseed to resend locally passed gun laws. they said that it went around a legal issue that by law state legislatures preempt decisions made at the local level. >> the notion of preemption is a part of our law in pennsylvania that prohibits municipalities from passing local regulations of firearms. it's a set of regulatory powers that the general assembly, our state legislature has reserved to itself. act 192 was designed to bring more force to that preemption. >> but it may be subject to constitutional challenges. philadelphia pittsburgh and lancaster argue that the measure passed in 2014 was inappropriately attached to a bill on scrap metals. >> in a sense does the nra have nothing to lose here because you'll have your fees covered either way. >> if the act is found unconstitutional our fees are not covered. just because it's put in place asystemmic, we have our legal fees and they don't, does not mean that it's right. many across pennsylvania heeded the warning. lancaster, philadelphia and pittsburgh feel they have special
