billy murphy is joining us from baltimore. thanks for joining us. what do you say, these attorneys representing the six baltimore police officers, they want her to recuse herself. they say in part because of you, that you once represented her in some sort of legal mat earn. i assume you've heard of this. tell us what's going on. >> i haven't read the motion and i'm not going to comment on the particulars of the motion until i've done that i think everybody can understand that. but it is almost impossible for this motion to succeed. because it really is an attack on marilyn mosby's integrity and impartiality and there's no base toys make that attack. marilyn represents an assumption that public officials will do their job correctly. you have to have evidence that she is not capable of doing the job. how do you do that? that doesn't strike me as something that's easy to prove at all. >> did you represent her in some sort of legal matter in. >> i have no present recollection of doing that. but i'm going to look. if it's the case i'll have to address it

back to baltimore, where billy murphy, attorney for the gray family joins us. mr. murphy the police union called for a special prosecutor in this case even before maryland mosby issued her charges. and a couple of points they made. one, they said that you contributed to her campaign. also, that you were on her transition team. they say that's a conflict of interest. would a special prosecutor, at least, erase that doubt. >> you know, we never heard these conflict of interest charges during the last state's attorney administration. i was on his transition team too. we never heard these conflict of interest charges ever before in the history of baltimore. i think that because the police are now on the side of the -- on the opposite side of the prosecution, we're hearing this kind of stuff for the first time. and it's interesting that the police union itself contributed almost as much money as my son did. the contribution didn't come from me. it came from my son. theyettely were on ettevidently were on the same side as mosby ran for attorney but sour grapes prevailed.

i think as you look to billy murphy speaking there, he really views there as perhaps a moment in history, a point to turn the corner in national history in terms of dealing with perceived or, in fact, police misjustice around the country and one of the key players in all of this today has been the state's attorney here, the youngest state's attorney of any major american city. her name is marilyn mosby and today there is no doubt the mood has changed here as a result of the charges she brought. >> the manner of death deemed a homicide by the maryland state medical examiner. >> reporter: baltimore state's attorney marilyn mosby saying the arrest of freddie gray was illegal and his death was a homicide. >> we have probable cause to file criminal charges. you heard billy murphy condemn that kind of statement. your reaction? >> my raemdeaction would be this. look at the family. the family has declined to rush, to rush to judgment. the family has said, we're seeking justice. we're not seeking to -- to rush to judgment, to hang these officers. they've exercised restraint. so i would ask why can't the police union do the same thing? the police department has admitted that there's, there was an unauthorized stop here. that freddie gray was confined in this van without a seat belt. we know that the interior of the van is not a cushioned suv. this is a very dangerous place to be if you're un -- i should say, if you don't have a seat belt on and you're shackled and handcuffed. so by their own admission, there was a breach of all kinds of police protocol here, and so i believe they've rushed to judgment in a way that does not speak well of them. >> you have confidence in this prosecutor? >> based upon what we've seen thus far and her emphasis on the integrity of the process. her emphasis on avoiding leaks. i beli

they say the lead attorney for the gray family billy murphy, served as mosby's personal attorney in the past. and they go on to highlight that the gray family attorney is mosby's mentor and a major financial supporter of her. sara sidner is outfront tonight. how serious are the charges against the prosecutor? >> reporter: well the defense certainly think theys they're serious. if you talk to some people they say those will get thrown out. we'll have to wait and see what the court does. i want to go down through a fuf of the things that are listed. this is a lengthy document. some the things mentioned we knew about, the husband that's a councilman mr. mosby is a councilman in the same district where they live and where gray was killed. a lot saying hey, this is a conflict because she could give personal or political gain to her husband because she did the charges, that the community there wanted. also that she knows some of the witnesses, has a relationship with the witnesses. that is one of the charges. that these defense attorneys are making. that she has this personal relationship wit

murphy contributing $5,000 to ms. mosby. they in fact themselves contributed almost the same amount of money. so that is something that takes place in politics anywhere you go people contribute money. i don't see anything there. her husband being a member of the city council, that is ridiculous. those accusations are basically i guess, was a response in terms of the fop just trying to muddy the waters. one of the interesting things, they called for special prosecutor. well, we were fighting for special prosecutor in the legislature this year in terms of all police review. the fop opposed it. they are totally contradict themselves. these motions in terms of her having any type of conflict of interest as she indicated, are just about ridiculous. juan: what about the issue of the possible motion for change of venue when a trial occurs? in new york city, we of the infamous case of -- a decade ago and there was a change of venue all the way to albany, about 150 miles away, reducing completely different jury and eventually,

murphy danny he represents the gray family he noted $5,000 to mosby's campaign. is that a conflict of interest? >> well when it comes to donizations -- >> yes. >> tom says yes. >> one could argue every donation is potentially conflict of interest. just to take the devil's advocate side when the people elect a prosecutor they should be electing a prosecutor knowing that that prosecutor might have to prosecute not only citizens but police officers. and that would be the job of any prosecutor. i mean in theory you could elect somebody that has zero ties to law enforcement. zero experience. zero knowledge of anybody in the law enforcement business. but then you have to ask the question how palatable a candidate for a law enforcement position would that be? you know it's a hobson's choice. you want to elect somebody who has substantial experience in city government law enforcement, and the business in general. but at the -- on the other hand you don't want to necessarily elect somebody who is so firmly entrenched that they can't be impartial. it's always going to be a

so your colleague, billy murphy said charges make sense. why, in your view are you convinced these are the right charges for these police officers? >> with the information that we have right now, and again, that is limited information, because we are not privy to all of the information that the state's attorney's office possesses. but with that information, the charges in this case do make sense at this point. >> do the state's attorney reach out to you or let you know she would be revealing these charges, that she had come to an assessment? >> we learned about the charges at the same time that everyone else learned about the charges. >> and there has been some criticism from many in the legal community who say, you know perhaps she may have overcharged and that could jeopardize this case. >> anyone that's saying that if they don't have access to the information that the state's attorney office has, they're saying that in the dark. in other words, they don't have all of the information with which to make an act ras assessment of the case th
