waterfront and they told us to be out of seattle and headed north. they have clearly beaten that by a couple of weeks. at this point the kayakers are back onshore. their barge remains at eliott bay. we're not sure how long it will stay there. there is another drillling rig in he have writ everett north of seattle and you can bet that the focus of the protest the demonstrations on the water and on land is going to move north to he have everett in coming weeks. >> you said that these protesting kayakers did not think that they would actually be able to stop this. but they didn't want to go down without a fight. from where you stand do they seem to have been successful? >> it depends on how you define success. the rig is long gone. it's headed to the arctic to explore for oil. they put up a very good show. they put up a very good fight. they drew the attention of the media for the month that the rig was here in seattle. i think the most fragment of them would admit that's what they had in mind. that's their ultimate goal. a few of them believed they do

at the seattle space needle. they posed as shell oil officials, invited local business leaders to attend the launch and unleashed an oil spill from their miniature oil rig. the nice lady was also an activist. she was in on it. it was a stunt to call attention to shell's drilling activities in the arctic and it did get all sorts of press when they did it. and now that shell is back out there to try drilling again, the yes men are at it gone. the yes men posing as shell employees again. they took to the streets of new york city to offer passersby free sno-cones. the big chunk of ice they offered they said was from the last chunk of ice from the last polar ice. free sno-cones from the last polar ice ever. come slurp the arctic with shell. shell's now waiting on the last few permits to start their drilling in the arctic. honestly, it seems clear, they're never going to be able to do this in peace. it's going to be a long, hot summer. ♪ [music] ♪ defiance is in our bones. new citracal pearls. delicious berries and

we're in seattle with the latest. tonya. >> reporter: david those protesters tried and failed to stop that drill from leaves the port of seattle as it embarks towards alaska and that drilling mission. it's not over yet. at this moment that drill is an hour and a half north of seattle near a town called port townsend. there's another attempt to stop that drill from leaving the area. one of those protesters is our city councilman mike o'brien. he's vocal about some of the environmental impacts the potential of environmental impacts of drilling in alaska, off the coast of alaska. he along with 24 other protesters were detained earlier today and fined $250 for protesting out in the waters in kayaks trying to stop that drill from leaving the port of seattle. >> i respect the rules. when i'm up against a company like shell who is inviting our shoreline permits and perhaps violating the constitution, who pled guilty to eight felony counts of last time they were in the arctic and violating maritime and environmental laws and
