we don't know yet know what this order means for kim davis fully wlasmt we do know is that kim davis has never granted her authority for any marriage licensing to be issued while she was in jail. she remained the clerk and kentucky law says marriage licenses must be issued under her authority. her objection has been that licenses could not be issued on her authority or under her name. now what we have is deputies issuing licenses really on judge bunning's authority, on the federal district court judge's authority and on his order. so we don't know that those licenses are valid. in fact we believe that they are not because they weren't issued by kim davis's authority. what she will do going forward when she gets back to the office -- we still haven't figured that out exactly. we haven't even had a chance to speak with kim as her entire legal team. only some team members have been with her and it's been very busy. but we will understand what kim's wishes and desires are very soon. and then she'll proceed accordingly. i think what she can say for sure is she won't violate her conscience

that is what kim davis is violating. she is saying she has a religious objection the following a kentucky statute, which is neutral and very simple and just says clerks must issue licenses. she doesn't really have a legal argument because the courts have never observed the public officials have religious -- can have a religious exception to just doing their jobs. so we are making a very simple argument here that just says public officials must do their jobs. if there's a conflict with their beliefs, they need to resign or lobby the general assembly to change the law on the meantime, but they still have to follow the statute and issue the licenses. nermeen: joe dunman, there's a hearing on the case today. on what grounds, if at all, or to be possible for the judge to rule in kim davis's favor? >> i don't know. i don't think there are any grounds. we made a simple motion. we have an injunction in place that requires her to issue licenses. she is violating that by not doing so. we simply ask the court impose a financial pen

davis' attorney who is representing kim davis and along with a couple of other colleague, and matt, thank you for being with me, and those words rang out very loud, and is this issue of authority is where we are headed, the next frontier of the battle, are you and your client about to wage battle against the certificates that have been issued and are you going to challenge them, and have the certificates denied now as illegitimate? >> well, kim davis and our staff have not really had a chance to focus on the issue, and we will talk to her later on that, and she was up until the wee hours of this morning, and ultimately wrote the statement and made the decision. what we are doing right now before we get to the validity or the invalidity of the certificates is to pursue the other appeals rr already there. we are filing the brief on one of the appeals this week, and we are asking for the court of appeals to issue immediate releaf for kim davis which could dissolve the case in terms of one of the complaints, and one of the arguments, and also filing another lawsuit against the governor

call me confused about what kim davis is saying this morning. she said any unauthorized license that they issue will not have my name, my title or my authority on it. can she do that? can she just take her name off it? what does that mean for the validity of the licenses? >> yes, there is a lot of smoking mirrors here. the good news is that this is not going to impact the validity of the licenses. the reason why is kim davis the individual is different from the office of the clerk in this particular county. the court has ordered the office of the clerk and the official who is the personification of that office to issue licenses. that office is now issuing licenses. and kim davis may object to that, but her office is now doing what is required to do under the law. so i think that because this was done pursuant to a court order binding her office, her licenses are going to be legal even if kim davis wants to maintain a little bit of smoking mirrors in the process so she can feel like she is living up to whatever view she has. >> kim davis, though,

he says that kim davis said i was humbled to meet pope francis. he even asked many eto'o pray for him. he thanked me for my courage and told me to stay strong. christine, we know pope francis on the way back from his u.s. trip on the papal plane was asked about his support for conscientious objection in general. he said it is a human right and a right allowed for by law. he was asked if that included government officials. he said government officials are human people and, therefore, they are also included in these rights. we know the pope met with the little sisters of the poor. this is a religious group of nuns that run health care in the united states and are currently involved in litigation over the contraception mandate. at that time on wednesday in washington, d.c. when he met with them the vatican spokesman said it was obviously a sign of the pope's support for the sister's cause. so we can say in general, although the vatican is saying they are not confirming or denying the meeting that pope francis does support the question of conscientiou

kim davis could have stayed out of jail. the judge told her she could go free if she gave her deputy clerks permission to issue licenses. davis consulted with her attorneys and refused. we get more now from cnn's alexandra field in ashland, kentucky. >> reporter: kim davis is refusing to issue licenses ever since the supreme court made a ruling earlier this summer making same-sex marriage part of the law of the land. davis was forced to appear in the court this summer where she was ordered by a judge to issue those marriage licenses. she has not complied. she is appealing the case. in the meantime, she refusing to issue licenses. brought back to the same federal courthouse in kentucky, the judge ruled she was in contempt of court. he ordered her remanded to the custody of the u.s. marshal. that surprised many in the courtroom expecting davis would be fined. judge said that would not be enough to compel her to follow his orders. while davis is now in jail, the judge called six of her deputy clerks to the stand. five of them h

but no sign of kim davis. we thought she was going to come to work, but then it became clear she is taking a couple of days with her husband and family. we're told she will be back at work on friday or possibly even as late as monday. in the meantime the issuance of marriage licenses going on. and one of the deputies here today was asked directly will you go on issuing if she comes back and tells you not to. and he said i will. and he gave that answer to mark who is in from san francisco. he is here with his partner alan, they have been together for seven years, and they came here to rowen county really to make a point, but because the supreme court said they could get a marriage license anywhere in the united states, they wanted one here, and they got one this morning. here is what mark had to say. >> i think that no matter where we had rights to marry, i think part of it is that now we have the right to marry everywhere. so i got married in rowen county. >> reporter: and mark says he doesn't think it is righ
