i'm michelle griego. >> hi, everyone. i'm frank mallicoat. developing this morning mayor lee is calling for a federal investigation into the police shooting of mario woods. kpix 5's jackie ward is in san francisco where pay city supervisor also plans to introduce a ballot measure today about officers' use of force. >> reporter: good morning. there's been a lot of conversation following the death when police shot and killed mario woods on december 2. but now we're seeing some action. mayor ed lee wrote a letter to the department of justice asking for a federal investigation into the shooting along with a deeper look into the department. in a letter to u.s. attorney loretta lynch, mayor lee says this would build a deeper trust between the public and police. lee has been under fire for what many call his lukewarm initial response to the shooting. sf supervisor malia cohen joined the woods family in asking for the federal investigation and will announce a balance measure that will require the office of citizen complaints anytime an officer fires

i'm michelle griego. >> hi, everyone. i'm frank mallicoat. good morning. it's 5:00. >>> a plumber stuck in a trench in east oakland for more than 13 hours is now safe. oakland firefighters managed to pull the 42-year-old man out this morning. he was barely conscious as he came up. this happened at 24th avenue and east 24th street. the man wheeled into an ambulance around 2:00. anne makovec has more. 13 hours a lot of work, anne. >> reporter: yeah. it's been a long day for is guy and the whole neighborhood. this is a very slow-moving the hole is shored up and covered up. the rescue was ongoing for 12 hours yesterday ending at 2 a.m. that's when this man was pulled from the ground next to a 10- foot sewer line. he had been working on that line when the trench collapsed on him at about 12:30 yesterday afternoon. rescuers had to work to stabilize that trench so they could pull that man out safely. they gave him some pain medications and kept talking to him throughout the rescue. his head was about 7 feet below the ground and one of his feet lodge

. >> i'm michelle griego. a gruesome twist in a south bay murder case. police have found new clues that suggest a missing campbell man may never be found alive. kiet do is in san jose where the man went missing. >>> reporter: the family of kyle myrick plans to keep up the pressure so they are meeting every day across the scene from the crime scene to organize daily search parties. it's a challenge because the search area is large. the victim, kyle myrick, presumed dead by police. investigators say that the suspect steve hlebo dumped the body in the ocean but it's also possible that the body is somewhere in the santa cruz mountains. it started friday afternoon as a fight when the two mechanics were assembling all-terrain vehicles at their shop gp sports on camden avenue. a pool of blood and trail of fresh blood was found inside the vacant burned-out building next door. police say it appears as though a body had been dragged from the scene to where the suspect had parked his truck. a dark gray 2003 gmc sierra 1500. the detectives say a blood found inside t

. >> i'm michelle griego. this morning, detectives in san leandro are talking to suspects and witnesses to try to figure out why gunfire erupted outside a busy shopping mall and who is responsible. kpix 5's anne makovec is at bay fair center where the shots were fired last night. anne. >>> reporter: yeah. this is a pretty busy place at 6:40 p.m. that's when those shots rang out. so police are still talking to people this morning and reviewing a lot of surveillance footage trying to figure out exactly what went on. at one point, the bay fair mall was locked down. it looks like the shooting occurred between 2 groups on one side two men who were walking in the parking lot, on the other a group of people driving in a car. and police still trying to figure out their relationship. but they say this was not a random act. >> one of the things we will always look at in a case such as this where you have a shootout in the parking lot of a shopping mall is whether or not gangs are involved in this and right now we do not

i'm michelle griego. >> hi, everyone. i'm frank mallicoat. it's 5:00. after all that heavy rain an high winds and flooded roads this morning, we have a break but it won't last long. multiple weather-related warnings are in effect. let's get to roberta for the latest. >> we have our live hi-def doppler radar and has been picking up plenty of precipitation in the microclimates and as it does so, primarily most of it happens to be confined to the peninsula and the south bay. extended forecast, we are settling into a weather pattern where we'll see rain just about every other day, which is a good thing for two reasons. first off, it's beneficial rains. and secondly, it gives us a chance for the soil to dry on out and get ready for the next storm system to roll in. today's storm 4, tomorrow a break, friday storm number 5 through saturday morning. saturday afternoon dries out. we have a break on sunday. then monday this is a comparable to today, about a tenth inch expected here in the bay area. we dry out on tuesday. wednesday is stronger, a potential for gus

. >> i'm michelle griego. in just about an hour, a search will restart for a missing surfer in marin county. he was last seen on the north end at rodeo beach in the marin headlands last seen in the water on the beaches north and apparently unconscious. two other surfers were with him at the time around 5:30 last night. anne makovec reports. >>> reporter: there's a lot of concern about this guy this morning. the search for the missing surfer will resume at daylight. rescuers had to give up last night after searching for about two hours. it was just too dark and dangerous to continue. the missing surfer was first sported by two other surfers in the water at about 5:00 last night. he was unconscious and so they tried to give him cpr in the water but it was too rough. >> a large wave came in, hit them, and they separated. the three separated. the two regrouped and tried to find the downed surfer and they were unable to. >> reporter: so the surfers returned to shore and called 911. several agencies couldn't find hi

[ yelling ] >> reporter: that's the cell phone video from one of those parties. this is on halloween about 4,000 people gathered at the party that spilled out on the streets and a riot started. then in december a student fell from a roof at a party and died. >> we're not trying to kill all the parties. we want to just make sure that they are done properly. >> reporter: so the new ordinance would limit parties to 200 people. it would force them to end by 10 p.m. on weekdays and 1:00 a.m. on weekends. and prohibit alcohol in common areas in places where minors live. enforcement would be a challenge with
