jack: local 5's nikki davidson was in the courtroom tonight and is here with the latest in tonight's big story. nikki? nikki: right... now that doctor has been cleared grays death... it wasn't until four years after gray died that a lawsuit was filed seeking damages on behalf of his wife and daughter who wasn't born until after his death. its the timing thats an issue here... because the statute of limitations says these types of wrongful death suits must be filed within two years. tonight his wife's legal team tried to convince the iowa supreme court that those rules should be changed... musician paul grays wife says even though the couples daughter wasn't born before her dad died... his loss will always be with her. 2:57:52 this child has life, born and lives everyday without her father, theres no father to be with her for birthdays and christmas. his wifes legal team is fighting for damages on behalf of both of them... but because that wrongful death suit was filed two years too late... it was dimissed in district court. thats what's brought the case here to the iowa supreme court
