now check in with nbc 10 monique braxton. she's been out there on the scene and gathering new information. monique, what can you tell us? >> reporter: just moments ago we saw am track police and investigators arrive on the scene. they are interviewing passengers as they leave the triage center. that's over at the united methodist church. all along this stretch of langley and 9th street, which is we have seen them taking away passengers to local hospitals. we're not sure of the extent of their injuries but we're told they are just being checked out. what we can confirm for you, two people have died and one person is injured. and they say they felt a jolt while hearing a bang and a pull of smoke was seen. here is what else we can tell you. 341 passengers and 7 crew members when investigators say it struck a backhoe on the track. we're learning passengers are being checked out as we know the train was heading new york to atlanta, georgia. suspended between new york and philadelphia. wilmington newark line. at this point passenge

one of those people at the mall at the time was nbc 10's monique braxton. your car was even searched as you were leaving the mall. is that right? >> that's right, vai and tracy. there was an incredible police presence here at the mall just after 7:00, i was in a line of folks leaving. police stopped me. i asked what was going on. they said a baby had been taken and they needed to search my car. they checked my back seat and then waved me on my way. if you're just waking up, we want to take you through what the scene looked like here at the mall last night. take a look at our video now. it was unbelievable, chaotic and, you know, it's something you will never forget. police were at every exit, leaving the mall. they were talking to people. we talked to some of those shoppers who had also been stopped by police. >> we're just absolutely shocked that that was happening here. >> that seemed to be the sentiment of everyone we spoke to last night. police were walking through the mall, the suspect seen on surveillance videotape leaving the mall with a 7-week-old b

monique braxton live on the scene. monique, you just spoke with police. >> i spoke to chief inspector head of homeland security and s.w.a.t. officers. he told us right now a suspect he's been taken from 600 block of east westmoreland. the s.w.a.t. team and firefighters have cleared the scene. but this is still a very active investigation and here is why. police sources tell us inside the home are two men and one woman. some have gun wounds to their head, they are deceased inside east westmoreland. we're told one man was able to rundown the street. he's taken to a local hospital. in all four shot here in east westmoreland, three are deceased. homicide detectives on the way to the scene. we're told this incident began hours ago, about two hours ago, when shots rang out and residents began calling police. when police arrived, the gunman had barricaded himself inside the home but he was on the phone with a 911 operator telling them he was armed with a shotgun and there was at least one dead person here with him inside. pol

nbc 10's monique braxton is live at the scene. you've been out there for some time, you've been able to speak to investigators, what's the latest on the search for this gunman? >> hi, katy. crime scene investigators have been on the scene for more than an hour. we've been watching them initially with flashlights searching for evidence such as bullet casings and now with the light of day they're going to hopefully get a better look at what transpired on the street and what is left behind from the actual crime that occurred. investigators tell us they were called here to the 400 block of wyoming about two hours ago. we've also learned there was an argument between teens at the emergency cafe lounge. then a 17-year-old was shot in the chest outside. now, that teen victim was taken by a private vehicle to a local hospital, he has passed away. i asked police about teens at the hookah bar and they told us they're trying to determine if there was a special activity going on. right now, a clear motive isn't known, but i can tell you we've

nbc 10's monique braxton is live in the digital operations center to explain. monique? >> many people learned about the abduction via their smartphones. this morning we're looking into why the emergency alert sounded nearly four hours after the 7 week old was captured on mall security cameras leaving the mall with a stranger. we examine the three-step process in pennsylvania. first, local authorities notify state police. state police then notify the national center for missing children and that group pushes out the alert from washington d.c. this was the scene as you know encountered by people at the mall. police told us they were called at 5:45 thursday evening. the police chief told us word spread almost immediately. >> an amber alert did go out minutes after this abduction. >> but the iphone time stamp for the montgomery amber alert shows it wasn't received until 9:36 thursday night. to issue an amber alert, law enforcement must believe that an abduction has occurred. they must also believe the child is in imminent danger. they need enough descriptive information to

nbc 10 monique braxton is live on the scene. >> reporter: investigators are still here on the scene at north cherry road and kelly drive. still a very active investigation. you see firefighters, philadelphia police, also the philadelphia police marine unit dive team and just on the other side of that truck is the tow truck. they are trying to lift the car out of the water. in the past hour the person has been recovered from the river. witnesses tell police just before 3:00 this morning the driver who had exited southbound roosevelt boulevard on to north ferrari road drove right into the river. witnesses also say the person appeared to be speeding. we do not know the identity of the victim but we can tell you police say he is in his mid-20s. and right now they are trying to lift his body off of the curb there on the stone fencing that surrounds the schuylkill river. we're going to stay on top of this investigation, stay on the scene and continue to get updates from philadelphia police. live for now in east falls, monique braxton, nbc 10 news. >> we'll check back with you shortly. >>> a

monique braxton live, what have you learned? >> reporter: new information, police have recovered a semiautomatic handgun. outside the house you see a growing memorial, a makeshift memorial. we've also learned the mother's boyfriend turned himself into the district office at 8:00 last night. when taken to homicide, he told investigators he was playing with a gun and it fired striking the 4-year-old girl. our camera was at 244 east mayfield yesterday shortly after the little girl was killed. sources tell us as many as seven children were inside the home when the gun went off 2:30. ly police told us their investigation revealed a 5-year-old shot the child in the face. we now know it was a man inside the home. we also know he fled the scene and turned himself in last night. he's confessed. we're awaiting word on homicide charges. we've already learned dhs is part of the investigation because of the number of children inside when the little girl died. live for now in kensington, monique braxton, nbc 10 news. >> thanks for that update

monique braxton is at the mall. we begin with nbc 10's drew smith, outside upper merion township police where the suspect is being held. drew, walk us through what happened. >> reporter: tracy, right now we can tell you, that woman is still being held here. we're working to find out the exact charges she will face. let's go through this step by step. it was surveillance video from the mall that officers put out to the public shortly after the reported abduction around 5:30. then tips started coming in all at once. police figured out who she was and started checking locations where people had seen her. they moved from point to point in montgomery and chester counties, eventually find her and the baby at a home in tredyffrin township. when that news reached the dozens of the baby's family members here at the upper merion police station, there was a huge sense of relief. the family want to know what was going through the accused kidnaper's head and why she had to put them through this. >> the woman who was found with t

monique braxton, nbc 10 news. >> thanks. right now police in camden are looking for a man whom they say shot and killed his own mother. nbc 10 was on the 1100 block of 18th street last night. as you can see there was a heavy police presence right after the shooting happened inside the suspect's house around 5:30. police have not released the suspect's name. friends tell us that they say this was unexpected. >> i know that he's not that type of person. he's a good kid. i believe a victim of circumstances because he would give you the shirt off his back. >> neighbors also say that the mother and the son had a strained relationship. >>> the attorney for a south jersey father accused of killing his 3-year-old son wants the murder charge against his client thrown out. the attorney has filed motions claiming that authorities failed to read the 22 year old his rights before interviewing him about his son's death in october. the lawyer alleges that the medical examiner waited five days before examining the scene where the 3 year old

nbc 10's monique braxton live with the details. monique. >> hi, rosemary. as the memorial grows outside this house, that new information we learned this morning includes not om hat mother's boyfriend turned himself in, he told them he did strike accidentally while playing with the gun using a.45 caliber handgun the little girl will this is what we also learned. he turned himself into the district office 8:00 last night he told detectives he had the gun in his hand when he accidentally fired striking 4-year-old. police recovered.45 caliber semiautomatic hand done. we just learned that. our camera at eastfield shortly after the little girl was killed. sources tell us as many as seven children that's also new, were inside the home when the gun went off at 2:30 in the afternoon. initially police told us their investigation revealed a 5-year-old accidentally shot the child in the face. but we now know it was a man inside the home who fled the scene and turned himself into police last night. he has confessed and at this moment we're awaiting word on homicide char

monique braxton is live with details. >> first of all, let us explain to you it is a three-step process to get those phone alerts out in pennsylvania. take a look at what we've been able to gather after doing some digging. local authorities first notify state police and they notify the national center for missing children and then that group pushes out the alerts from washington d.c. upper marion police chief said his department did what they needed to do quickly. >> the amber alert went out to all surrounding jurisdictions in montgomery county within the first few minutes. >> by 7:45 thursday night it took one hour to obtain appropriate information and pictures. their amber activation occurred at 8:48 p.m. now, with that activation, state police notify the national center for missing and exploited children in washington. that's the agency which pushes the button to send cell phone alerts. the cellular send process can take some time. it took 45 minutes on thursday. we'll continue to delve into what takes place prior to the amber alert you receive on your cell phone. we'll also hear mor
