we begin with the former virginia governor's case. after more than a year of appeals, the supreme court has weighed in on this. >> it appears that former virginia governor bob mcdonnell may be getting a new trial. julie what does this mean? >> this was the last ruling to come down so we're still sorting through all of the details but the jury instructions in this case, the supreme court has ruled, were flawed in the way that official acts were flawed. bob mcdonnell will not have to report to prison to serve his two-year prison sentence today but it doesn't mean that he's completely clear yet. the justices found that the constitutional official act is too broad. that means that governor mcdonnell's conviction is overturned but it's going to be up to the u.s. attorney's office to decide if he will be retried. there's a challenge for the prosecutors because the supreme court ruled that what prosecutors maintain that mcdonnell did, bribes that they say he accepted, they completely ce i just talked to nbc pete williams a short time ago and

we could start to virginia. it's down in this area now, flash flood warnings ongoing where they have already seen so much flooding over the past couple of weeks. notice the flash flood watch in the dark green here. that includes shenandoah county. more now to the south and this is the area that's been so hard hit in west virginia. they are once again under flash flood warnings so we hope that they are okay and they are going to make it through tonight's storms. there they are right there. it's a front. you can see that front clearly defined here. the northern portions spinning off towards the east but down to the south, this area is kind of stalling out. that's what will happen tomorrow and that will lead to another round of storms tomorrow. this evening, tracking a couple of storms and showers that move through. 10:00, most of them out of here. watch what happens tomorrow morning. not much. just cloud cover. tomorrow afternoon, a few storms fire up at 3:00, 4:00. one or two could be on the strong side. not expe

this is one of the hardest hit areas in west virginia. we are downtown where just a few days ago this entire area was under water. smoez maul businesses were all that's left of the fragile economy that's been suffering. across the state, hundreds of families don't even have homes to come back to. you can see one of those individuals is diana sanders. you can see her home in this video being carried down a flooded creek. her husband, billy, was inside that home. he's one of the 23 people who have lost their lives in these floods. and now diana, like so many others in the mountain state, spent the last couple of days searching for debris, looking for their belongings, including pictures and her husband's knife collection. >> they found him in between those two houses under a bunch of stuff. i'm not going to cry. i won't. not in front of you. >> reporter: this weekend, president obama granted federal disaster declarations for the state's three hardest hit counties. today, the governor of west virginia visited those areas and the massive reli
