. >> "today in the bay's" kris sanchez live where that happened. chris, can you tell us more about the investigation? >> reporter: all we know is that the investigation is happening so far behind us that this is about as close as we can get to the homicide scene. it's in the parking lot of the lowe's home improvement store off interstate 880 in san jose. it has been about six hours since police found the body of the victim and no sign of his killer. the man was unconscious at the time and injured badly enough that it was obvious to officers who are a rooifd on scene this was not an accident. about 200 yards from the crime scene is the entrance to a homeless encampment. we don't know whether the two are related. san jose police have been on scene since about 10:40 last night, combing for clues. what they have found they have not revealed to us yet. if they release a suspect description, we'll bring that to you as soon as we can. this man is san jose's 38th homicide victim of this year. kris sanchez, "today in the bay bay.". >> thanks for the latest

"today in the bay's" bob redell is live at the summit for us. what are things looking like from your perspective? >> reporter: good morning, sam. we're seeing a light rain, a misty drizzle. headlights behind me on highway 17 are heading north into silicon valley. police and fire are asking that you watch your speeds, keep your distance between you and the car in front of you. otherwise you end up with what they had yesterday on highway 17. the nbc bay area crew was out here when there were three separate accidents that happened at roughly the same time. in the most serious collision paramedics had to transport two people to the hospital. first responders were so busy with all these accidents, they had to rely on mutual aid, calling in extra help from cal fire. the resulting backup stretched for a couple miles in each direction. the people w

kris sanchez with a precaution they are taking this year. >> good morning. you know as a parent we generally get notices in the backpacks about halloween costumes and guidelines, but this is the first time i can recall having gotten a notice that clown costumes are now on the banned list along with fake blood and weapons that are part of a costume. across the nation, police departments have been investigating incidents, people dressing in scary or creepy clown costumes approaching children or grown-ups. the union high school district sent a letter specifying there have not been specific verbal confrontations with clowns, but because there have been inappropriate and sometimes threatening posts on social media, they banned clown costumes outright. san jose unified school district has done that in some of the schools. costumes have to be appropriate for school, but no clown costumes, no fake blood, no weapons. nothing extremely gory. parents have gotten notices. we know a lot of parents are talking about this. even the san jose police department responded and

"today in the bay's" pete suratos has more on the evacuations under way. pete? >> reporter: good morning, laura. that fire, what is called the creek fire, is more than 50 acres. cal fire says it's got about 25% containment. we're at the crosswalk church in napa where evacuations are supposed to come. haven't seen any here yet. they do have a number for nonemergency purposes. crews have been here through the night working hard to contain this blaze. t

it includes the area where kris sanchez is out there live in the truck. how are conditions out there? >> reporter: well, i can tell you the roadways are very slick, mike. we have seen ponding on the roadway. haven't seen any of the crashes that you're talking about. i want to make sure you know i'm not driving. josh is driving with both hands on the wheel this morning. you can see the windshield wipers are working about medium right now. this is all clear on northbound 101, just passing moffett field here just past 237. earlier this morning, though, there was a pretty serious crash in terms of visuals on northbound 87 just south of kerner in san jose. the chp tells us the driver lost control in the weather, driving in the rain and ended up on the median of the interstate -- racketer 87 there. so not only was that a traffic obstruction at that point, but it is going to continue to be a traffic obstruction once the crews come back to make the repair to the center divide. that is clear and now we're watching -- hopefully we won't see any other collision like
