north carolina. let's take a look at north carolina. it closes in less than an hour, little more than an hour or so from now. north carolina, there's already a court case involved. democrats are challenging one of the polling error. >> they say there were machine issues early on. they have lines and they're trying to keep the polls open in this county. 2.8%, about 3% of the state's population. why are democrats saying keep it open? let's go back in history. here in 2012, durham county, 76% for the democrat, president obama. 23% for mitt romney. if you go back to 2008 when president obama carried the state pretty much the same. you pull out to the map here. that's 2008. go back to 2012. obviously this area of the state, the raleigh/durham area is absolutely critical in this battleground state. durham in particular. they're in court trying to keep them open. this is what we're going to watch all night. this has become -- florida was the closest election in 2012. demographically, north carolina is probably the most closely contested battle

there are those who say we should watch north carolina and north carolina alone. why? >> well, the democrats think and the republicans don't argue it's a checkmate state. if hillary clinton can win, it essentially blocks donald trump's math. let's go through some of this math. this is where we have the race right now. clinton at 270, trump at 179. republicans will argue this a bit. but for the sake of this hypothetical, let's say hillary clinton pulls out nevada in the early voting with latino. and let's say trump has a good night, otherwise, winning florida and ohio, look where that gets him, at 243. even if donald trump from this point on, let's say donald trump does crack the blue wall at 243. even if he were to win michigan and wisconsin, it's not enough for him if hillary clinton wins north carolina. it would take her over the top. so one of the other things you look at here, if donald trump wins pennsylvania and these stay blue -- go back for me, there we go, she gets over the top. so it's 15, it's part of the important map, but also the message. david axelrod lo

north carolina is a tight swing state. barack obama won by less than a percentage point in 2008, mitt romney won in 2012. every vote matters in north carolina. rich, tell us about this case and what you see. what stands out to you? >> the legal redress. and i have been the legal director for west virginia on help america vote under the bush-cheney campaign. here is what's happening. there is a federal law which requires if you are going to purge your list it has to be done 90 days before the federal election. the naacp is claiming the state of north carolina is trying to purge their list within that 90 days. they are saying they are violating the national voter registration act. north carolina says we have a state law that allows us to purge people so our state laws take press debts. but the states take money from the federal government and say we the agree to follow that act. if there is a violation, these are all allegations at this point. jenna: eric, what do you think? >> north carolina has to understand federal law tr

we know how important north carolina is to donald trump. what states are you watching most particularly tonight? >> erin, i'm watching five states very closely tonight. this won't be too much of a surprise. this is our battleground map. the three remaining tossup states on the east coast, new hampshire, north carolina, florida, i'm watching all three of those pretty closely for different reasons. one, if florida starts looking like it's going hillary clinton's way, donald trump is going to have a very tough evening. it's almost a complete blockade state for hillary clinton. if she wins that state and wins it early, donald trump will find himself scrambling to get to 270. he starts on our map with 204. without this huge electoral prize in the sunshine state it becomes very difficult. north carolina, one of the closest-contested states of the race, i think it will be a nail-biter, it came come in late so i'm watching that to see how such a closely guided state shakes out and new hampshire, those four electoral votes could be critical to donal
