bringing in tom fuentes, our senior law enforcement analyst a former fbi assistant director. strikes me about the fear of what people think of him as a muslim is, when you talk to non-violent law-abiding muslim-americans, they express a similar concern. there's a, some leap that he took to be violent or to be radicalized. what are you thinking happened here? >> i'm not sure what happened, brianna and you're exactly right. a degree of derangement on his part to say, i don't like the fact that people think of muslims as possibly terrorists. so i'm going to become a terrorist, or become, you know, violent to try to murder people. so i think in a way it makes no sense. we don't know, and in a way the authorities may never completely be sure of what exactly triggered him to do this yesterday. to all of a sudden decide, i'm going to drive my car and run people over. i'm going to try to stab them with a knife. even though there have been story after story of that type of thing happening all over the world. including september 20th. the mall attack in saint cloud, minnesota, where a

let me go to tom fuentes, former assistant director of the fbi. he's on the phone with me. he's been following all of this. so we do have this information now, tom, the federal law enforcement official believing that there was one suspect involved in the attack. that suspect now is dead. what does that -- they also, though, stress this is early in the investigation, though, and the sweep continues. what does that tell you? >> it tells me that when we heard that the individual was transported to the hospital, many of them not having life-threatening injuries, that means they would have been in a position hopefully to see what happened, to see who was either shooting or stabbing people, and provide a lot of information to the police as they were being transported to the hospital and at the hospital itself. police would have received a great deal of information and may have been told that the best anyone knew, it was only one person doing the attacking. we do have all the reports of many people hearing gunshots so whether we have gunshots as well as stabbing victims is yet to

fuentes and deborah feyerick, covering this from new york. you're getting information, we heard local police at this news conference say this was done on purpose. someone deliberately took a vehicle, drove up to a crowded sidewalk, started ramming into people. the vehicle then stopped. the individual gout out with a butcher's knife, it's been described and started slashing people. this was done on purpose. we have to consider the local law enforcement authorities saying this could have been a terrorist act. what are you hearing? >> wolf, i can certainly tell you the fbi and other law enforcement people are right now treating it as if it was a terrorist attack. absent other information, absent any other indications. certainly the way in which this attack was done, the vehicle used to strike pedestrians, people on the sidewalk, and then the attacker coming out of the car with a knife, all are indicators some kind of a terrorist attack. whether iies-inspired or inspired by another group, that's something that needs to be figured out. they have n

jeffrey toobin is with us, and our senior law enforcement analyst tom fuentes, as well. jeffrey, based on the description of events, do you agree with the decision to not bring charges against this police officer? >> certainly the d.a. made a convincing case, but i am not in the position that the authorities are down there. one thing i think the authorities did do well here is that they were open about the process. they disclosed a lot of evidence. they let the public see all the evidence or just about all the evidence that was available to them, and that sort of transparency i think leads to more credibility when the government makes a decision. and here, when mr. scott had a gun, it unfortunately is really something that is pretty conclusive, even though in much of the country, including north carolina, a lot of people carry a lot of guns a lot of the time. >> tom, the district attorney admitted that there was no evidence that mr. scott ever raised his gun or pointed the gun at a police officer. is it still appropriate for an officer to use deadly force in that type of
