we have new information on this settlement. >> reporter: thank you, dan and ama. the settlement is for more than $3.5 million. it will be divided between michael tyree's sisters and young daughter. >> it's a resolution of a very sad, heart wrenching situation. >> reporter: attorney represented michael tyree's two sisters in the excessive force claim against santa clara county. they have settled for $3.62 million. >> they would rather have their brother or father or, you know, being here than any amount of money. but there's no amount of money that's going to fix this. >> reporter: the county counsel released a statement, but would not comment otherwise. three jail guards are awaiting trial, charged with killing tyree. they say they beat him to death in custody. it is unusual for a civil case to be resolved before the criminal case. >> the county wanted to distance itself from the three guards and the conduct their accused of. what this settlement says to michael tyree's family, it's a statement of remorse. it's a statement of sympathy. >> reporter: the attorney fo
