i'm dan ashley. ama daetz is off. a baby boy is in the hospital tonight after he was attacked by the family dog. the dog was then shot and killed by police. this happened just after 4:00 this afternoon on the 2100 block of fremont street in concord. sky7 was over the home where a year and a half old shepherd mix named charlie reportedly attacked the 10-month-old child. his mother was in a room nearby. the child sustained injuries to his head. 911 was called, and he was rushed to the hospital. abc7 news reporter laura anthony spoke with concord police about what happened. >> very tense and a very scary scene when they were getting this call. when we get here, the dog is actually still running freely throughout the yard. one of our biggest challenges was getting to that child, getting that child out safely without having one of our officers get charged by the dog. we were able to successfully do that. the child is doing pretty well now, but unfortunately that dog was neutralized by one of our officers. >> police say the

dan ashley is on assignment. we begin in breaking news in san jose where that overflowing creek has flooded several san jose neighborhoods. one new neighborhood being threatened tonight is a mobile home park on oakland road. this is the south bay mobile park. coyote creek is on the other side of the wall you see right there. the wall is already leaning and officials don't know if it's going to hold. police have gone door to door telling everyone to leave. there are at least 200 units under mandatory evacuation orders. two of the residents are senior citizens, both invaldez. one of them just lost her husband. there are two other nearby mobile home parks also under evacuation orders. in addition the water is contaminated. authorities are asking anyone who comes into contact with it to rinse off their clothes and their shoes. there are still showers around the bay area tonight. meteorologist drew tuma tracking them. >> and i want to give you an update on the creek. that flood warning has been extended. will expire n

. >> and i'm dan ashley. thank you for joining us. we're following breaking news in san francisco. president trump's travel ban. >> the ninth circuit court of appeals here in san francisco upheld a washington state judge's suspension of president trump's travel ban. the president ordered travel from predominantly muslim countries. the three judges announced their decision just before 3:30. >> the government has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the united states. that's from the court. washington state's attorney general addressed the decision a short time ago. >> bottom line, this is a complete victory for the state of washington. the president does have a choice. he can continue to fight this or he can tear up his executive order and start over. i would strongly consider him to consider the latter. >> president trump tweeted, "see you in court. the security of our nation is at stake." >> and lisa amin gulezian has reaction to the ruling. >> reporter: dan, there were a few people out in front of

i'm dan ashley. >> and i'm ama daetz. tonight officers say they had no choice but to shoot and kill the dog. the attack happened this afternoon on fremont street in concord. >> the baby is being treated at childrens hospital oakland, and that's where abc 7 news report yeh katie udas is live with this developing story. >> reporter: i spoke with the baby's father on the phone and he told me he's doing okay but he didn't want to comment. he witnessed with his 7-year-old son what police are calling a traumatic event. >> shots fired. shots. >> copy, shots fired on the dog. >> reporter: concord police shot and killed a family dog that moments earlier attacked a 10-month-old boy. >> the dog was very aggressive actually. took an aggressive stance toward our officer. and that's why our officer discharged his firearm. >> reporter: an officer ran inside to get the baby. >> when the officer pulled him out, quite the emotional scene. having to wrap his head. >> reporter: the boy underwent surgery at oakland children's hospital after s
