( will ) firefighters on the scene. a man is stuck inside the shaft of a "togos" restaurant in napa. we were on the scene of a shooting nearby, and heard about this story. these two incidents are not related. early this morning, workers inside the restaurant faintly heard someone crying for help. they called 911, and firefighters got there, they realized a man was stuck in a shaft on the roof of a restaurant. police do not know how he got in there or why he was on the roof in the first place. they've been working for several hours to get him out. we spoke to a worker on scene who was doing construction on the building. he says their work is being put off while the rescue is underway. construction worker who had been there for several hours says he had a co-worker who heard someone crying for help. the worker told him to get back to work and then he heard a cry for help.

sharon joirning us live this morning from the togo's in napa. sharon, this is a story that gets even more bizarre from there. good morning. >> reporter: that's right, sam and kris. it becomes even more bizarre because the man was found naked inside of the shop. you can see right behind me. it was awhile before fire fighters tried to pull the man out of the shaft. once they thought he was okay, fire fighters couldn't believe how he got there. witnesses say the man who was found in a fetal position at the bottom of the shaft has a history of climbing this togo's building complex possibly camping out there overnight. but last night or early this morning fire fighters say he apparently gained access from a rooftop door to the shaft and fell to the bottom. workers who arrived at the building this morning said they heard someone faintly crying, help me, after searching awhile they figured out where he was, talked to him through the wall then called 911. >> i get into the dumpster area and i'm opening dumpsters behind. it was nervous what i might find.

man who was going do door-to-door selling magazines is under arrest accused of sexually assaulting a napa woman inside her home. it happened just before 6:00 last night on pine street. a transient named lester morris ivy was selling magazines when he entered the woman's home uninvited and attacked her. ivy is in jail on a sexual battery charge. the victim is recovering. >>> we have new details on the deadly shooting of a man by napa police officers last night. the man was reportedly stabbing and slashing at cars on a home depot parking lot. police say that officer shot and killed a man after he turned towards them. investigators say they founding a knife next to the man locked in the open position. the man is 23-year-old noel russell from napa. >>> a brother wants justice now that one of three suspects arrested in a deadly freeway shooting and in court. abc 7 news reporter lyanne melendez is live outside superior court with more reaction from the victim's family. >> reporter: well, dan, it was a very short court appearance and that's because the arraignment was delayed, but i can tell you

( will )it happened just before 6:30 last night in front of a home depot store. this is near highway 121. this is video of the scene, from of our helicopter partnership with abc 7. police say they were responding to calls about a man with a knife walking around the parking lot. when they arrived the man walked across the street. officers approached the man and shortly after that the situation escalated and two officers opened fire killing the man. right now investigators have not said exactly why the officers started shooting. police have not yet released the name of the man who was killed. the napa county sheriff's office is investigating the shooting.
