rosenstein nor -- and neither mr. rosenstein nor mr. sessions can do so. neither rosenstein nor sessions can ever convince the public that they are pursuing their boss, the president, if there is evidence that leads to his culpability. they report to him. rod rosenstein reports to jeff sessions and he in turn to the president of the united states. that's why the appearance and the reality of independence is so critically important and why only a special prosecutor can pursue that interest. if we were in normal times, rod rosenstein would be an eminently acceptable nominee, and i would welcome his nomination without attaching any kind of request or condition. he is certainly an honorable public servant. he is a h career prosecutor. i admire his commitment to public service. as united states attorney for maryland, he certainly has an admirable record, and he is in some senses what we value in the department of justice -- someone committed to the rule of law. that's why i have been surprised and disappointed that he has failed to heed my request. whatever hap

rosenstein's nomination. i hope we can work together constructively on the important matters facing the department of justice. mr. president, i yield the floor. mr. schumer: mr. president. the presiding officer: the democratic leader. mr. schumer: first, let me thank my friend from illinois for always his thoughtful and good words. i agree with his sentiments on mr. rosenstein, who i will support as well. now, first, mr. president, i want to say that it's really good news that the president seems to be taking the wall off the table in the negotiations we're having on an appropriations bill this week. it would remove the prospect of a needless fight over a poison pill proposal that members of both parties don't support. on a bill as important as one to keep the government open, it's -- it's a dangerous prospect for the administration to push so hard for such a flawed, incomplete and unthoughtout proposal on a must-pass spending bill. it could tank what would have been productive, bipartisan, bicameral negotiat

rosenstein has earned so much bipartisan support to serve as the deputy a.g. that the judiciary committee reported out his nomination with all but one member voting in the affirmative. so clearly there's no need to force additional procedural hurdles on this nominee. and yet, mr. president, our colleagues across the aisle have decided to force an unnecessary cloture vote on his nomination anyway. the latest in a long pattern this year of needless democratic obstruction that is not intended to change a result, just delay for delay's sake. i would urge our democratic friends to reconsider what they are doing. mr. rosen stiern is a highly qualified nominee and well respected across the political spectrum and within the legal and law enforcement communities. he should be confirmed without further delay. on another matter, over the weekend we lost one of conservatism's most insightful journalist with a passing of kate o'burn. kate was a long leading voice for conservative principles and she served as a mentor to so many all along t way. in a town full of class pres
