cosby powers back. he's back. he's been restored. >> while the prosecution promises they're not done. >> we will take a hard look at everything involved. and then we will retry it. >>> good evening. i'm denise nakano. jurors in the sexual assault trial had a rare saturday session this morning and quickly returned with their ruling. the jurors only discussed the case for about an hour today before declaring they were hopelessly deadlocked. leaving the judge to declare a mistrial. bill cosby didn't speak following the announcement, but the d.a. said he will retry the 79-year-old comedian. until that happens, cosby remains free on $1 million bail. we've had a team of nbc 10 reporters covering the trial since it started. tonight we have team coverage of today's big decision. nbc 10's andrea cline-thomas spoke with members of cosby's team. drew smith has reaction from outside the courthouse. but let's go to randy gyllenhaal. >> reporter: you mentioned the jurors returning for a saturday deliberation. did not last long.

. >> reporter: andrea constand sat just feet away from camille cosby, the wife of bill cosby. defense lawyers told the juror that cosby had a secret fling with constand and he didn't want his wife to know about it, they also laid out a story in which constand was lying. they were lovers and bill cosby didn't want his wife to know. that's what his lawyer spent two hours trying to stress to the jury. a number of times saying cosby was investigated and cleared in 2005 because the district attorney then found constand was lying, giving inconsistent stories and changing the dates of when the assault allegedly happened. the closing argument was powerful. he's begging them to end this case. he says constand is lying and so is another accuser who testified about a 1996 assault and they say the only reason the case was carried out is because cosby's 2005 deposition where he admitted to getting quaaludes in 1970 was unsealed. it had nothing to do with party drugs and there's no proof that's what he gave constand. camille cosby sat on one side of the courtroom, constand on the other. per

cosby. i want to read some quotes we received from, again, jean casarez and lawrence crook from inside the courtroom. he asked each juror, polled each of them and said does this indicate that the jury is hopelessly deadlocked and the foreperson said yes. the judge again then asked all jurors do you agree there is a hopeless deadlock which cannot be resolved by further deliberations and each juror then again answered in the affirmative. the cosbys' defense, they asked for a motion for mistrial and that was granted. then the judge made this comment to all the jurors. probably one of the more courageous acts, the selfless acts i have ever seen in the justice system. i feel bad for you all. he also said i'm compelled at this stage to grant a motion for mistrial based off manifest necessity. so again, they have been deliberating for about 53 hours since they received this case on monday. they have been trying to come to some sort of agreement on three counts of aggravated indecent assault, assaul
