i'm looking at the notes we're getting from pete williams and nbc colleagues. travel ban decision will be argued. the case will be argued in october. that's the supreme court. if you want to be bare bones about it, they're disagreeing with arguments of the trump white house that it was so urgent had to be done immediately, had to be reinstated until it is heard or that it should be heard right away on the next briefing schedule. october is a long way from now. supreme court saying we'll get to it on the normal review. as to the white house on your question, the president hurt himself repeatedly with ex-tem pran yus comments, that's a legal fact. some folks feel like maybe nothing matters, a president with a different style, everyone has to live with it, he is the lawfully elected president. as a legal matter, his tweets quoted back to his own lawyers to hurt the case. very interesting to see how the president and his administration responds today. hallie, i don't have to tell you, this is the big show in town. this decision now to hear the case in october will

williams, and pete williams, those officers are expected to be okay. again, all of this unfolding just after 7:00 a.m. on the east coast in alexandria, virginia. this is just outside washington, d.c. the situation right now, though, according to law enforcement officials, stable. this is a situation that is under control. they believe they have the lone gunman in custody. a number of folks who were there at the field describing him as a middle-aged. we're told he was wearing blue jeans, a blue shirt, and he had a riechfle. we heard from congressman joe barton from texas a few moments ago. he said that it also appeared as if the gunman had a pistol as well. perhaps even a semiautomatic pistol, said that the shooting went on somewhere between five and ten minutes. a number of other eye-witnesses say at least 50 shots were fired. it would seem as if, as the morning has gone on, that 50 number may be a conservative estimate as well. but again, right now, steve scalise, the congressman from louisiana, in surgery. he is in stable condition. we just got that

i want to start with nbc's justice correspondent pete williams. tell us about this young woman. >> well, i think any administration would have done this leak case because it really fell into the government's lap with a lot of particulars and they could hardly ignore it. she's 25, she works for a contractor that does work for the national security agency, and it turns out that she was arrested over the weekend. now h arrest was disclosed barely an hour after the on-line website the intercept published a story based on the nsa document that the government says she leaked. the document talks in more detail about the broad outlines of what we had known previously about russian efforts to get into local election systems on registration. you'll see the little black bars there on the document, things that were redacted. what the intercept says and the government says the same thing, that the intercept once it got the document, called the nsa and says, hey we've got this. we're going to publish it. what do you think. the nsa asked certain things be redact

one is this russia investigation, which you were just talking about with pete williams that involves jim comey, both committees looking into russian meddling and influence in the election. so, all of the new news if you will in the last 24 hours taking place on the house side you have four subpoenas in that russian investigation jointly issued by republicans and democrats on the committee, jointly supported for michael flynn and michael cohen, former national security adviser and president trump's long-time personal attorney. michael cohenles with business entities associated with those. there's not a ton of controversy around those. it's note worthy they did issue the subpoena for michael cohen. the flynn subpoena is what the intelligence committee has been up to. the second piece are the additional three subpoenas that are around unmasking of names and requests from the obama administration and you can see obama administration officials there on the screen, that may have made these unmasking requests and this is the former head of the russian investigation but still the chairman of

we get details from our justice correspondent pete williams. >> reporter: for the first time in five months, a legal win, at least a partial one, for president trump after a series of setbacks that blocked enforcement of his executive order on travel. the court granted his appeal of two lower court decisions against it and said some of it can now be enforced. a 90-day pause on issuing visas for travel to the u.s. from six muslim countries associated with terrorism. the white house has insisted that, to protect national security, it must use the pause to assess background information provided by those countries on visa i cannot allow people into our country who want to do us harm. the court was unanimous on agreeing to take up the president's appeals, but by a vote of 6-3, it agreed with the lower courts that the travel ban cannot be enforced against anyone seeking a visa who has a close relative here or wants to come here to study or teach or is coming here to accept a job offer. that means anyone in those categories can still apply for a visa. that's why the challengers say this is

nbc's justice correspondent pete williams is standing by for us. pete, what were the arguments that the justice department made last night? >> three, basically, craig. first of all, they say that you shouldn't have a nationwide ban based on only a claim by what they now say is a single person in maryland. a man who wanted to bring his wife from iran to the u.s. that you can't have a nationwide ban based on one person's complaint. at the very most, the ban should apply just to the one person. secondly, they say the -- the justice department says the lower courts are wrong to rely on statements made by candidate trump. that's been the crux of the lower court decisions here, that this is a muslim ban. it's based on religious discrimination. you just have to look at what the president said during the campaign. the justice department says those statements shouldn't count. that puts the courts in trying to psychoanalyze what a candidate was saying. all that should matter is what happened after he became president and signed the executive order. finally,

but i want to go to pete williams in our d.c. bureau. you saw the president say it, he believes james comey is a leaker. you see his outside counsel saying this there will be a leak complaint filed. can you walk us through on a legal perspective. what teeth does this have and could it have an impact on comey? >> well, first of all, let's admit that it's been successful because it's what we're talking about and now about what mr. comey said about the president. i frankly think that's what this is all about. what they say is he's going to file two complaints, one with the department of justice inspector general. now that seems like it will be somewhat, because at the time that mr. comey by his own admission gave a friend of his a copy about one of the memos that he wrote about the flynn meeting and asked him to get the note out, he was no longer in the government. the insctor general investigates what people in the government do. now arguably when mr. comey was in the government he took the memo home. but if that's the sum and substance of

i'm joined by pete williams. let's go through what we know right now. i guess how long was this shooter planning this attack? because all of the anecdotal coming out, this seemed not only was it planned today but maybe for some time. >> i don't know the answer to that because the federal authorities tell me they don't know the answer to that. let's go back on a couple points that have been confusing all day long. there were four people shot today. given the number of rounds that were apparently expended based on eyewitnesses, that's quite a remarkable thing. the congressman steve scalise, another congressional staffer, a staffer from another congressman, a staffer named zach barth, a lobbyist matt mika and a capitol hill police officer. and then of course, the gunman himself was shot and killed. a second congressman, representative roger williams of texas, injured a leg and an ankle, and another capitol police officer also was injured but not shot. so that's the first thing. secondly, the gunman, 66-year-old james hodgkinson, belleville, illinois. a hom
