)( james ) ( james ) another big story this morning ... new video was leaked ... showing a deadly shooting involving a bart police officer.( darya ) shaleem tindle was killed january third when a bart police officer shot the 28-year-old across the street from the west oakland bart station. the leaked video is from the officer's body camera ... and we want to warn you ... it's graphic.( james ) in the video you can hear an officer initially say raise your hands. then gunshots. then more gunshots ... then he says raise your hands now. we froze the video because of the graphic nature of the shooting. tindle's family has filed a civil claim against bart ... a gun was found on the ground at the scene. the family admits that it was tindle's gun but say he was not holding the gun when the officer opened fire. bart released a statement last week saying that they are conducting multiple investigations into the shooting and that they will release all relevant information
