joining me is daniel goldman, former assistant u.s. attorney for the aforementioned southern district of new york. daniel, let's start with taking the fifth before we get to the image of the president on the floor in the residence of the white house going through sealed boxes that say federal evidence. we all learned in civics that it doesn't imply guilt. so what does it mean in this case? >> well, the sort of bare case that it doesn't mean that much is that following the searches and the revelation that there is an intensive investigation of michael cohen, any defense lawyer who represents michael cohen would say i'm not going to have this guy under oath, even if he's innocent, because somebody else thinks he's committing crimes. so anything he says could be used by them and therefore could be incriminating. but it's not, as michael avenatti said, necessarily an admission that if i speak under oath i could be incriminating myself. that's not what the fifth amendment is and that's not what he's doing by asserting the fifth amendment. >

in the stormy daniels affair? >> well, i think it could be, because not only does it affect the enforceability of the contract, but it also suggests that michael cohen might have done some things that are unethical. it is a lawyer's duty to keep a client reasonably apprised of all matters. it is a lawyer's duty to discuss settlements with their clients and not to enter into settlements unless they're so authorized by their client. so these statements could also get michael cohen into some ethical trouble with the state bar of new york. >> phil rucker, in the good old days, when the white house and campaigns had messages of the day, you wouldn't have made unethical actions the message. but if you look at the day in total, between scott pruitt's antics, between barbara's statement of michael cohen's conduct as a lawyer, unethical seems to be a pretty good way to wrap up the day. what story -- what part of this story do you think irks the president the most? >> it's probably a few things. i think he's feeling a lot o

now, we know that stormy daniels' team wants to go and a quick trial. they want a deposition and move forward with the litigation and the federal judge is saying wait a minute something has to be decided. i have to make a decision about whether this matter will be referred to private arbitration. i'll i'm not allowing to you start discovery. i'm not going to set a trial date because a fundamental question has to be answered as to the validity of this arbitration agreement. rook, when they remove this matter, cohen's team from the state to the federal court they did so for this reason. they knew that federal judges are no nonsense, play by the rules and a federal judge doesn't like the fact that stormy daniels' attorney didn't make himself available for what's called meet and confer. they want lawyers to work out these things like extensions. they don't want you running into court every time, you know, there is a request, particularly a request like this for a simple extension of time to respond to a complaint. so the judge wasn't too happy with stormy d

the president's online statement attacking stormy daniels on the matter led to stormy daniels and her attorney threatening yet another lawsuit in this case. now they're threatening to sue the president again not just over the initial agreement, but now for defaming stormy daniels today. based on the president's online tweet. the stormy daniels part is high profile. lots of new stuff happening in that every day. tons of media coverage. lawsuits. spawning law suits. the president himself being sued already once in that matter. maybe soon it will be twice. but if you, you look at that, sort of step back from all of the, media noise around that. when you drill down and look at that substan tich tively. the stormy daniels matter is small. tech technical. sued trump specifically because of this. because, see where that is highlighted. see her -- her signature there. but that's highlighted line there, see, no signature. the president didn't sign the agreement. that's the basis for the whole stormy daniels lawsuit. the conflict between stormy daniels and the president is he didn't sign on the

stormy daniels, starting with you, joe, on that one. the judge granting the 90-day delay in the lawsuit against trump it appears likely that trump's personal lawyer will be indicted in a separate criminal investigation. does the delay hurt the president by dragging this out longer? >> i think it does. i think it's more bad news for the president. i think the michael avenatti is a very skillful lawyer. he's kept this front and center in the american public eye. and i think that he, the president's talk on with "fox & friends" host this week further complicated the matter because he admitted that cohen represented him on the stormy daniels deal. i think this delay hurts. and avenatti is going to challenge it, anyway. >> in terms of vulnerability overall, zirlena when you look at everything the president is facing, is it with the russia probe? the stormy daniels lawsuit? is it with the michael cohen investigation? where do you see him having the most vulnerability? >> there was a certain point where when michael avenatti came on the scene

so long as the contract between ec and cohen and daniels remain valid. avenatti's position is there is no contract. >> can the president face criminal charges? >> not for not knowing about the contract in a contract law perspective. but to the extent that may have been a violation of campaign finance law, there's potential criminal exposure there. but as a general rule of contract law, you shouldn't be entering into contracts -- large settlement agreements without the client's knowledge. because that's in evidence what this was. a settlement agreement. trump is a third party beneficiary. he is a party to a settlement agreement. that would make more sense. but again, the beauty of contract law is it's often whatever the party's draft, whatever they choose to sign or in this case not sign. their theory each of them has about breach of the contract. >> all right. let's turn to russia. the russian probe. sources tell "the washington post" the president is still under investigation by robert mueller's team. but trump is not a criminal target. do you think tha
