sinclair came back today, rejiggered its deal. now here is the rub, what we do know is that part of this whole thing, you could see this within sinclair's statements today, they were being completely honest and transparent with the fcc, the fcc is investigating sinclair whether they are candidate with the commission about their divestiture plan. if the fcc says they were not candidate, if this thing goes before administrative law judge the way sin klauer was divesting from the networks, i tell you this is funky divestiture, if you look at it. they were divesting from certain networks that is actually controlling. you have to look this stuff up. i don't have enough time in three minutes to explain it. if the fcc with administrative law judge concludes they have not been candid, that is a real problem for the deal. forget about that doj antitrust was poised to approve. there is separate court case whether to approve it or not on other issues. there has been civil lawsuits, litigation there on this deal but if the fcc says no to this

this is not expected that all. >> sinclair is going to have to restructure some of it. it agreed to divest about 23 of its stations to comply with the 39% ownership cap. what has happened in now is that the fcc is raising issues that some of those divestitures are not cleanly structured. sinclair is going to have to come back with a new proposal, squeaky clean, and present it to the agency. ♪ >> china and the eu are pledging to work together to defend the global trading system, amid rising concern about protectionism. talk to us about what china and the eu have agreed to do. >> well, we got some substance out of this one-day summit, even if it wasn't groundbreaking. we got the first joint statement since 2015 between the eu and china. they pledged to uphold the multinational trading system and open markets. we also got some movements around its financial investment treaty that they have been working on, both sides agreeing to exchange market access, which moves that forward. >> japan and the eu have signed a trade deal that scraps a wide range of regulatory obstacles

charlie: we are way ahead of sinclair. the sec said no to sinclair. the doj was poised to approve it. that caused them to reconsider. that deal has a lot of media stuff going on. they create a huge media. neil: not such a done deal. did you get a sense that he thinks this justice appeal could at the very least delay implementation of things he wants to do for many months? charlie: you know, he's not saying, but it is a bankers turned on a synergy. you have to combine new countries. it's hard to combine overlapping get rid of. neil: the court has to agree with that. >> the d.c. circuit court has to listen to that. in the meantime, did you go full steam ahead on the merger comic eliminating any sort of overlap would you keep them truly separate that makes the deal less advantageous. you probably have to keep it somewhat separate because of that. i think he is underplaying what this does. the other thing is the d.c. circuit court is stacked with consumers and liberal judges. that may vote in favor of trump. trump is going to rely on obama appointees basi

. >> it looks like there's an obstacle in this sinclair had to buy tribune. essentially, it looks like tribune is at least considering dropping out of the deal itself after the fcc basically gave it a no vote of confidence and gets pushed to an administrator judge which is a heavy lift after the fcc weighs in. sinclair has another problem. it has the fcc basically saying they don't like the deal . neil: is that not unusual? >> which part? neil: the fcc is spearheading this. >> right, because it's a positive to donald trump in this is the fcc of control. donald trump has applauded their coverage like crazy. that is unusual for this is now getting to the point where it looks like tribune has second thoughts about staying in the deal and it was interesting that we reported that tribune was dropping out and they put out a statement right after we reported that said yes, we are considering it and we are weighing our options. what was interesting as they do not run the statement by sinclair. tribune did it separately. it shows there's divergence between the two com
