amy hollyfield live for us in danville. amy. >> reporter: hi. good morning. the attorney for the family says there is surveillance video of the pool that day and that it shows 15-year-old ben curry struggling to stay afloat. it shows the p.e. teacher looking at something in his hand that looks like a cell phone. according to the police report, the 57 students in the p.e. class had been told to tread water three and a half minutes. this happened back in may at san ramon valley high school. the family's attorney says there were no lifeguards on duty and the teacher's certification had expired. >> we accepted the public apology that was issued six months after the incident. but the questions still haven't been answered. they don't know why this was allowed to happen. it is unheard of that someone 15 years old would drown in a swim class. and they want answers. >> reporter: the school district says it can't comment on pending litigation but did say the district has instituted a requirement that every time district pools are in use, dedicated and cer

. >> amy hollyfield is live at the scene. amy. >> reporter: hi, jessica. we asked investigators if this had anything to do with the detox center, were these people involved at all, were they patients, do they work there. at this point they say they don't know. they are still looking into that. that is a brand-new investigation. they got the call at 1:30 this morning to come here and found three people had been shot. one man was pronounced dead. they looked for the suspect in the area. they even brought in the chp helicopter to look from above. they were not able to find anyone. >> when deputies arrived, they searched the scene and searched the area with the assistance of chp helicopter. they were unable to locate the suspect. the suspect fled the scene. the immediate area is secure. and the area, no one is in danger currently in the immediate area. >> reporter: he would not elaborate, though, why this area is considered safe at this point. since they have no one in custody. this is in the area of sylvia parkway and smith ranch road in san rafael. we asked

abc 7 news reporter amy hollyfield checked out the damage in mill valley. >> reporter: heavy rain and wind blasted into mill valley around 7:15 this morning. the wind tore down this canopy that was covering a mill valley christmas tree lot. this power pole on panoramic highway is now leaning over. forcing pg&e to shut down the road while they work on repairs. this rain was round two of the storm. the first wave of wet weather came through in the middle of the night rngs toppling over this tree in mill valley. it landed on top of a pickup truck parked on east clydesdale avenue. no one was hurt. later in the morning after the rain had moved through a tree specialist came to survey the damage. >> that creates a surface area to catch all the water which adds more weight to the tree and then it falls. pretty common. >> reporter: lucas graves said he could also tell this willow tree was rotten in the middle because of the sawdust residue and the hollowness. he said an arborist can do an assessment to find out if your trees are healthy. you can also do regular maintenance to try to prevent t
