senator schumer. >> thank you senator nelson and for joining us here today. as senator nelson mentioned, we will just be making a statement at the end while the legal proceedings are ongoing. the more time that passes, the better things are looking for democrats. a few hours ago i met with the senators elect jackie rosen and kristin. just now, senator nelson was here to brief me on how things are going with the florida vote count. and following that meeting, i want to make three simple points. first, it is a bedrock support f support for democracy that every vote is counted and the senate election in florida must abide by that rule. every single florida voter, whether they mail in their ballots, whether they showed up at the polls on election day to vote, no matter for whom the legally cast their vote must have their vote counted. the hallmark of our democracy is simple. every vote must count. that is what we are trying to get done. president trump and governor scott are dead set against counting every vote. they worry if every vote is counted, bill nelson wi

now second, senator nelson just said it, i said it, and we'll say it again. governor scott needs to recuse himself from any involvement in the recount and do it now. he's a contestant in this election and can't possibly be trusted to be a neutral and fair arbiter as the votes are tallied. in georgia, secretary of state brian kemp even stepped aside for this very reason. any contestant in an election can't have a thumb on the scale while votes are being counted. and it's not just that governor scott appears to be conflicted. he said -- he has said and done things that show without any doubt how conflicted he is. the alleged tissue he alleged voter fraud where his own officials that he appointed said there was none. he's attempted to direct state resources to stop vote counting in locations that he knows favors democrats. just contrast the way governor scott is handling this with how republican governor -- how the republican government officials in arizona conducted themselves. governor deucey a republican, said, every vote matters. and the arizona senate race

eric: nelson 76 year's old. look, he's been in office 46 years, first elected 1972, what do you think the tipping point was in the race, so close 10,000 votes out of more than 8 million cast, scott campaign really tried to portray nelson as out of touch and out of sink and in office too long. >> the scott campaign an scott himself also repeatedly used the word confused saying senator nelson is confused. it was a tight race, a lot of money spent, the governor alone spent about $60 million of his own and the state flooded with tv campaign spots. this was also a big call by scott to nelson during the race that, you know, he also hit career politician, kept going with that, three terms is enough, it's time to move on and that's what governor scott graciously back and senator nelson thanking him for all of the years of public service. eric. eric: scott was a term limit as governor. what does this mean for the state, phil, now two republican senators as we pointed out in about century, as we look forward to 2020, flor

senator nelson: good afternoon. senator schumer and i just had a meeting to discuss the florida recount and we will be making a statement here as the legal proceedings are ongoing. this process is about one thing, making sure that every legal ballot is counted and protecting the right of every floridian to participate in our democracy. and that is to have their ballot counted and to count as they intended it. sadly it's become clear that my opponent isn't interested in making sure that every lawful vote is counted. instead, he's been using his power as governor to undermine the voting process. he's thrown around words like voter fraud with no proof. he's tried to get the florida department of law enforcement to intimidate local supervisors of election. both the florida department of law enforcement, which governor scott oversees and the governor scott appointed florida secretary of state have both said that there is no credible evidence of voter fraud. it's become obvious that mr. scott cannot oversee the process in

bill nelson had 100,000 more votes. he did lose twice as many here in broward as rick scott did. >> neil: i'm sorry i wasn't clear. in getting the final ballots here, did the numbers change? i know it's heavily democratic. nelson had a bigger lead there. substantial lead. did the final numbers then favor rick scott? in other words, rick scott has more votes than was earlier thought than the substantial votes that nelson already had? >> so and we still have not heard officially from the secretary of state in tallahassee that a hand recount is about to start, what time it's going to start. the numbers that are coming in from all of these different -- a couple dozen different machine recounts show that the scott lead has extended a little bit. but less than 1,000 for now. >> neil: got it. all right. again, he's trying to overcome about a 14,000 point gap between himself and the senator. now to the legal fallout from this. brian silver is here with us. that is an important distinction. obviously in these counts, it's very i

bill nelson winning big. 75%. there's still another, do the math at home, more than enough votes here and here for bill nelson to come back. if they come in 60%-plus and come in at that level of the precincts that are outstanding. that's the big question. if you're the republicans, you're leading. in the race for senate, 59,000 votes. almost 60,000 votes. round it up right there. in the race for governor, 8 83,0 votes. a bigger margin there. the democrats, this is nervous time. there's still votes to be counted and this is what happens in florida. >> right. democrats still have significant potential in those southern florida counties. let's go to texas right now. beto o'rourke apparently still ahead. >> just look at it for a minute because you don't see that very often. texas blue. this is a democratic dream. i was just texting with some people in texas who say this is real. we think we have a competitive race. do they have enough? do they have enough to pull it off? let's look at the map. again, focus first, not

nelson has had to play catch-up. to enterrt of weighted the contest, following the more traditional pattern in florida, which has been, don't bother starting the campaign for a laboride race until after day, because it is hot in august and people are vacationing. so nelson himself is caught a lot of flack from democrats and republicans for waiting a bit late. scott'sue that rick recent ads, which just started strongthis week, a very ad touting how well he responded to hurricane michael, and polls do show that voters do give him hetty good marks for how handled hurricane. for the last two, he's been much more aggressive before hurricanes and not just after, but then again, some people say that is expected and not a real reason to vote for one person over another. but this race has been even tighter than the governor's race from day one. we are seeing that the ads are the assets of each, and the other is trying to draw out the liabilities. the nelson ads against scott go back to the days of when his firm had some legal

things got hazy in columbia county when a vote for willie nelson could be for bill nelson, despite the confusion, ronna mcdaniel saw nothing improper in broward county. >> i sat at a table doing the hand recount. i will tell you it was very fair. there was no dissension. everybody was getting along. >> democrat bill nelson's lawyer posted a photo of a contested ballot and wrote this is why we have manual recounts. but, there is a math problem for nelson. most ballots in broward put on the projector today for review looked like this one. the senate race was blank. it's called an under vote and it doesn't go to either candidate. making it harder for nelson to make up the more than 12,000 votes he needs to catch scott. scott spokesman said today bill nelson has served the country and the state of florida for decades. his d.c. lawyers don't care about his legacy. awful they care about is changing florida's election laws ahead of the 2020 presidential race. there is no sign nelson will drop out though. instead he is digging in, asking supporters for money appeal his team will spend countles

just 12,500 votes separate rick scott and bill nelson. scott's lead in this race has dwindled over the last week, and on thursday at noon, when the machine recount is over, if it's over by then, and if the margin is still this close or closer, there will be a hand recount of all the votes. i spoke with nbc news national political correspondent steve kornacki earlier today. he told me earlier the hand recount is where things may get really interesting. >> in the issue in broward county is you had this extraordinary number of what they call undervotes, votes that were cast -- whoa -- votes that were cast for governor but were not cast for senate. there were about 26,000 ballots that left that senate contest blank. and the question is why in a county that bill nelson is getting 70% of the vote. in the nelson campaign says it's a machine issue. they were feeding them into machines. it was for some reason missing all the sfroerts the senate. well, if there is a manual recount. that will find that and they will find tens of thousands of ballots

in the end bill nelson's margin was too big or deficit too big against governor rick scott and nelson's only lawyer mark elias said in a conference call the other day we're not just looking for one silver bullet and proceeded to list two or three other factors they hoped would close the gap. the language itself was instructive, a silver bullet. basically saying that it was already a long shot and in order for nelson to close the gap, he needed to do a variety of long shot things. needed a number of silver bullets. then we saw the judge in a few different rulings just slowly take away that ammunition from senator nelson. now mathematically, unless something bizarre happens and this case somehow winds up before the u.s. supreme court and somehow the republican heavy u.s. supreme court decides to side with nelson, it is -- almost beyond a shadow of a doubt governor rick scott will be the next united states senator from florida. >> mark, a couple weeks back we talked of lessons learned from 2000. how that's coming to bear in this election. looking ahead to the next election, what have folks

senator schumer. >> well, thank you, senator nelson. >> okay, so we wanted to hear from senator nelson, who wants to obviously hang on to his senate seat. he's saying, listen, he wants to make sure due process is followed, that every legal ballot is counted in florida and had words to say for his opponent, who happens to be the governor. ryan nobles, my colleague, has been in the thick of all of this. it sounds like senator nelson is saying to his opponent, you need to bow out because can you not play this game fair and square as governor florida. >> let's be clear what senator nelson have said there. what he said is not all that knew. there wasn't all that much that was relevant to worry about what he had to say. but what he's talking about in terms of governor scott recusing himself from the florida, scott is the sitting government and oversees the secretary of state. the secretary of state is appointed by rick scott and is a republican, and what bill nelson is saying is that scott needs to recuse himself from anything having to do with the vote couldn't in hcount in his official pos

you saw there that nelson won palm beach county by 16 points. he got about 100,000 more votes than rick scott in palm beach county. it's a democratic bastion and there are a lot of people there. if you're in the nelson campaign, your entire strategy for recounts -- how do we expand the universe of legitimately counted ballots so that we have a chance to make up that gap? and how do you do that in heavily democratic counties because that's where you can make the biggest jumps? so a case like palm beach, that is the first place lawyers would look to say how do we find more legitimate ballots that need to be part of this count? and now with the news that palm beach is just reporting what they reported on saturday, that there is no adjusted number, there is no recount, the universe did not expand at all about what was counted in palm beach. that's a huge lost opportunity for the nelson forces to try to go to a democratic vote-rich area and try to make up some ground. >> so since senator nelson would have hoped to have blue numbers out of palm beach

that is the question nelson is facing at 3:00. >> harris: nelson is paying his attorney, he has to say nice things about his client. i think it's interesting that democrats have supported brenda snipes so much when it widths their side of the political aisle in primary season that was damaged by some of the illegality she engaged in. >> she has repeatedly engaged in illegality and failed to follow florida election law. florida is one of those states where the supervisor is elected at the ballot. the question we wonder is why have someone so experienced in election law, is she so negligent and following the law? that's why we've been so vocal on this. >> harris: is there going to be an investigation? >> there is an investigation today, you'll read the story and politico politico, that the florida democratic party altered the election document and encouraged voters to submit their votes late after the deadline. the florida democratic party altered those documents and encouraged voters to continue to submit ballots after that deadline. that leaks back to brenda snipes decision to continue

i think senator nelson said it quite well. if governor scott has nothing to fear with regard to a recount, why is he screaming as loudly as he is about nonexistent voter fraud in this election. it was very telling that yesterday on this network governor scott was asked point blank to provide evidence of voter fraud in this election by chris wallace. he was unable to do so. the republican secretary of state in florida said there is no evidence of voter fraud. a judge in broward county just about an hour ago squashed governor scott's want attempting to impound voting machines in broward county. let the votes count. >> dana: our earlier guest said scott is 12,000 votes ahead, unlike in the bush/gore recount, hundreds of votes separated them. if at the end of the recount nelson loses this race, will he accept the results? >> presumably he will. let the votes count. let the recount proceed. stop with the interference like governor scott's been trying to do. let me make one important point. there is one very peculiar situation in th

what we are waiting for is a statement from bill nelson. he is expected to release a video statement in about an hour. 3:00 eastern in which we expect he will concede. we don't know that definitively, but it seems to be the most logical conclusion about the statement that bill nelson will make in the next hour. what we learned today is really not that much of a surprise as we saw this process play out over the past five days. we had people in different spots around florida. it didn't appear that there were enough votes available for nelson to make up that gap that scott had built on election night. this was obviously a long drawn out process. many, many lawsuits filed in the fight over this florida recount. at the end of the day the election results we saw at least in the governor and u.s. senate race we saw on election night have held and it looks as though the republican will be the next governor and the current governor will be the next u.s. senator. fred? >> what about the variety of lawsuits? do they go away or would some remain? >> th
