we just talked with chp here in redwood city. we were in palo alto as that tesla was towed away just before 5:00 this morning. and according to redwood city chp officers, they say 45-year-old alexander stannek of alas los altos was going five miles over the speed limit when officers tried to pull him over in redwood city. officers turned lights and sirens on and no reaction from the driver. officers then pulled up next to him and found him sleeping behind the wheel. officers could not wake him up so they pulled a chp cruiser in front of the tesla to slow it down. and the fact that it stopped without a collision is why the chp believes that tesla was in auto pilot. he hadn't been going over the speed limit. if that autopilot had been set lower, your officers might not have had reason to pull him over. >> correct. they wouldn't have a reason to pull him over from behind. but as they were coming up to see if there is anything wrong with the vehicle, they would have observed the driver was asleep. >> reporter: so there was no erratic

( james ) in the south bay... police are investigating a deadly stabbing at ahome on ayer avenue in san jose. it happened around 8-30 yesterday morning. officers were responding to a welfare check at the home.. but before the arrived the call was updated to a stabbing. the stabbing victim... a man... was dead at the scene. police also found a man suffering from a gunshot wound. he was taken to the hospital with life threatening injuries. police have not released the names of victims. according to the redwood city chp, officers spotted that driver looking asleep behind the wheel, going about 70 miles an hour on highway 101 south, near whipple. officers tried to stop the driver, but he didn't pull over, so officers eventually had to pull a chp cruiser in front of the tesla, to slow the tesla down to a stop. that driver, 45-year-old man from los altos failed a field sobriety test and was arrested on dui charges. the big question now is, whether that driver was using tesla's autopilot mode. if he was, it would be the first time a drunk driver tried to use autopilot as a designated driver. rather it would not be the first time. in august, a monterey man was arrested after crashing his tesla into a san jose fire truck. he told officers that he thought he had autopilot on. back in january, chp officers found a man passed out behind the wheel of his tesla on the bay bridge, when he was arrested for dui, he told officers he thought his car was in autopilot. his blood alcohol consent level was more th -- content level was more than twice the legal limit. we don't know whethe

look at redwood city, they're below. san francisco, oakland and concord north and it is still bad in the unhealthy category. we start to get the little southeast breeze. a long time since it rained. but that ends tomorrow. so this is the last day for no rain and smoke and haze. plenty going on with the system. the jet stream will punch through the and it will not be till wednesday afternoon and evening. and there is some hints next tuesday and wednesday. aand we'll focus on the two wednesday and friday. and good totals through santa rosa as well. and we could start late rain tomorrow night and tomorrow morning. and we'll have a way up to the sierra. and the snow level will get back to the lake level. and the next system looks to come through on friday. we'll have to keep our eye on the burn areas. winter storm watch begins in the sierra wednesday afternoon and evening. the snow will go way up and then come down. we'll send in high and mid- level clouds going on in the atmosphere. that will help. but i think the rain hold
