good morning, reggie. yeah, the attorney for the family says there is surveillance video of the pool that day. they say it shows the teacher looking at something in his hand that looks like a cell phone. this happened back in may. it happened here at san ramon valley high school in danville. 15-year-old benjamin curry drowned in p.e. class. they had been told to tread water three and a half minutes. the lawsuit says there were 57 students in the pool and no lifeguards. and that the p.e. teacher's lifeguard certification had expired. >> there's not one expert in this field who has ever heard of a ratio 57 to 1. this wasn't the swim team or water polo team. it was a p.e. class, a required class for everybody. >> reporter: district officials can't comment on pending litigation. they say the district also instituted a requirement that every time district pools are in use, dedicated and decide lifeguards will be present. the teacher, aaron becker, still works here. the family says they have filed this lawsuit b

i'm reggie aqui from abc 7 mornings. it's 8:27. and that bad air, as you can see, still lingering across the bay area. and one of the worst places to breathe it in is in livermore. yesterday, smoke from the camp fire settled into the valley, which made for that increased air pollution. at 4:00 p.m., the air quality index read 272. once it gets to 300, air quality reaches hazardous levels. that's the highest number i've seen. >> yeah, it's brutal. that's the bottom line here this morning. and we can see all of that smoke and haze here on our camera, as well. so westbound 580, richmond side of the richmond san rafael bridge, about 20 minutes longer than usual. really no rhyme or reason for that. heavy volume in that area. and northbound highway 17 in the campbell stretch, just past hamilton avenue, giving you the thumbs up now. earlier crash has cleared. you are backed up, however, south of state route 75. that has a long way to go you know when you're at ross and you find a deal on cookware that makes you say. yes! ...oh,

. >> reporter: hi, reggie. it was considered one of the most hotly contested measures. it is known as our city, our home. that's what they were calling the initiative. but it really split city leaders. supporters sayictorythe homeles home and the help they need. it will charge big corporations that bring in more than $50 million a .5% tax. it will go entirely towards homeless programs. this is expected to double what the city spends on homeless services. salesforce ceo ben off was a huge supporter of this measure. >> my biggest surprise in this campaign for prop c is the people pushed back the most are the ones who understand the homeless the least. >> the measure also had big name opponents. twitter ceo jack dorsey was against it, along with scott wiener, and san francisco mayor london breed. prop c did not win two-thirds of the vote, so there is some talk that there will be legal challenges now. but while those play out in court, the thinking is the money will be collected from the businesses. but it will be saved, not spent, until this issue is finally resolved. >> s

i'm reggie aqui from abc 7 mornings. we are tracking a major crash in the north bay. a fully loaded u.p.s. truck crashed into a sedan that was sitting in the middle of northbound highway 101. this is near railroad avenue. the u.p.s. truck full of packages caught fire. the truck driver amazingly walked away, suffering a broken arm. no one was in that stalled sedan. all northbound lanes of the highway were blocked this morning. alexis smith, you're taking a look at what this is -- how this is impacting traffic right now. >> yeah, and they have oneggie the two right lanes are still closed. they were hoping to have everything back open by 7:30, but i am doubtful that's going to happen. that was just a huge mess to clean up. there is still a sig alert. we have twoanes down, northbound 101 at railroad avenue. and that is starting to cause a bit of a delay if you're coming from the pen grove area down to 5 miles an hour. so surface streets to get around that, if possible, this morning. here's a look at a very you know when you'
