>> it's so strange, brian. i talk all the time with people very close to the president, people in the west wing, outside advisers, also to top republicans on capitol hill. and to a person just about they say of course it's over. the president knows it's over. he just has to go through the process and run through these lawsuits. we'll give him some time to do that. but look at today on these lawsuits. you have the setbacks you mentioned in arizona, in michigan. by the way, with some really striking language from the judge in the michigan case talking about these affidavits presented by the trump team as being not just baseless but sloppily, directly contradicted by the facts. and then in pennsylvania five separate lawsuits tossed out. you have the trump team being the purveyor now it seems of frivolous lahs, the kind of frivolous lawsuits that i over the years have heard republicans including rudy giuliani who i used to cover when he was a mayor in new york, and they talked about going and combating frivolous la

>> let's unpack this, brian. under the constitution it says state legislators can decide how electors are chosen. every state without any exception has said that the people go to the ballot on election day or provide legal ballots by-election day and they vote for the electors. now, what lindsey graham is saying is maybe the state legislator in a place like pennsylvania could substitute their own state of electors. the problem with that is there's a statute on the books 3usc 1 that says appointing electors has to be designated by-election day. you can't change the rules after election day. so in short lindsey graham's proposal would be radical, extreme anti-democracy. and it would violate state law because the pennsylvania state law has already said if you do it by popular vote. it would violate federal law which says you can't make the change after election day, and it would violate the constitution. other than that, it's a great idea. >> would be interesting in that case republican voices rose up in protest. je

"the 11th hour" with brian williams starts now. >> well, good evening once again. day 1390 of the trump administration, 72 days until inauguration day. tonight the president still refusing to concede the election as president-elect joe biden moves ahead with his transition, and a plan to fight the pandemic. he just can't do so officially yet. today the incumbent president, his campaign and his cadre of loyal republicans continued their campaign of baseless claims of voter fraud going on all over the country. late today attorney general bill barr did them all one better. he wrote a letter to all u.s. attorneys on letterhead telling federal prosecutors they are allowed to investigate allegations of voter fraud. katie benner and michael schmidt of "the new york times," friends of this broadcast, both report it this way. quote, mr. barr's authorization prompted the justice department official who oversees investigations of voter fraud, richard pilger, to step down from the post within hours. the move came on the same day trump's campaign launched a lawsuit to stop the

kooe kyrsten sinema and brian kelly. this is so much a story of where this state has come in the last ten years. go back to 2011 in the shooting in tucson of gabby giffords. she was thought to be the arizona independent that would one day potentially run for higher office. it is now her husband who is going to washington this week to serve in the u.s. senate. it's also a story of the latino organizations, the grass roots organizations, when for so long the national political party of the democratic party didn't invest the sort of high dollars into this state. it largely alienated and it was the grass roots organizers who at the age of 19 got involvedton oust joe arpaio back in 2012. i met up with her just the week before election day. 8 years later, she said they realize there were national implications on the line. it was more than one sheriff, one governor, one senate seat, but potentially the presidency on the line here. when you're looking at this state here, this is quite a moment for this democratic party and quite

>> hey, brian. let's take a look here. so we're getting 53-47 right now. if biden gets elected, democrats obviously would love to have a democratic senate. they would need a net gain of three. if they get to 50-50 with a president biden, vice president kamala harris would break a tie in the senate. democrats would effectively have control. so they need a net gain of three if biden wins. let's take a look here. the first thing to remember here is functionally this is probably a net gain of four. there's a democratic incumbent, doug jones, running for a full term in alabama. remember some extraordinary circumstances got jones this seat back in a special election in 2017. tommy tuberville, his republican opponent, has been leading in the polls there. if that holds up, if tuberville gets that seat, then effectively democrats actually need a net gain of four plus biden's win to get them senate control. so let's take a look here. they need a net gain of four probably. where are they trying to get it? here

you know, max might seem like we already heard it from brian here. i mean, when i, when i look at american foreign policy makers in the media that there is this run for, i don't, the top that russia has no legitimate security interest of its own. it's almost taken as a given. and i find it so bizarre because everything, every country, every nation state has interest in it will obviously pursue it. but russia, when it tries to pursue its, it is somehow some kind of rogue character on the international stage. i mean, do you find that frustrating? i do find it frustrating a limit because on what brian said and kind of go back to what michael's talking about. i think the what my whole brian described actually under obama, the real issue was, would on a very negative trajectory end this crisis. the way you describe syria, you're crazy, are still there. and you know what michael says, he is more optimistic outlook for what may come next for us fresh relations. i'd love to side with him, but i just don't see any objective grounds for, for this optimism. sim
