at his instructions and to fulfill his wishes donald trump had sent them there. they truly believed that the whole intrusion was at the president's orders and we know that because they said so many of them actually posed for pictures bragging about it on social media and they tagged mr trump in tweets folks this was not a hidden crime the president told them to be there and so they actually believed they would face no punishment the defense argued in their briefs and they argued again here on tuesday that the insurrectionists were acting on their own that they were not incited by president trump or acting at his direction this is in their brief quote they did so of their own accord and for their own reasons and are being criminally prosecuted but that's just not the case it's not what the insurrectionists actually sat they sad they came here because the president instructed them to do so leading up to the attack the in-service action and said they were coming to d.c. for president tribe he invited them with clear instructions for a specific time and place and wit

to have donald trump as a witness. so we'll never know, probably, on the development of the evidence exactly what he knew about that statement of his going to the capitol. he knew he was lying when he said he was going with them. did he know he was specifically violating the law of that permit when he was making that declaration? >> i mean, if past is prologue, the notion that donald trump would have an understanding of that level of detail is very far fetched. i don't think he would know that. i understand your point. certainly it would be, you know, a nice little piece of evidence in a courtroom trial but we need to disassociate this notion that what we're going to start to see tomorrow in the senate chamber is akin to a courtroom trial. it's not. it's very far from a courtroom trial. there's nobody who is making any evident area ruling. there's nobody making any rulings as to what arguments are okay. what arguments are not. what law is okay and what law is not. what facts, you know, you can rely on, what you can't r

trump didn't. trump wasn't shy about using his channels, he did, but he did it hour after hour after hour. in the end, i think some viewers were baffled by this, but i think it's rather telling, because as a lawyer, what you don't fight about is as important as what you do. i have two points that i have to make in any argument. what we saw in the end is senator lee raise a procedural objection and say, look, i never said something they're saying i said, so i want it stricken. then senator leahy was very hard to follow, and it looked like senator lee was going to set up a partisan almost 50-50 vote on whether or not his rights were being violated. then you had jamie raskin jump in, the lead house manager, say, we don't need this. we'll withdraw that testimony. we don't need it at all. such a smart, strategic move to keep everyone's eye on the ball, that what happened was a side show. raskin gets it. >> raskin was so impressive. he had a move along those lines yesterday when he literally yielded back
