he felt like michael cohen just went too far. it's interesting to think back in retrospect on those things. >> it's very interesting. first of all, the fact that two of the president's lawyers, personal lawyers have now been the subject of this kind of extraordinary search warrant is amazing and remarkable, in and of itself. but what happened with michael cohen, he turned into a cooperator with the federal government, as a part of what happened after that read, i don't know that that will happen with rudy giuliani. rudy giuliani really wants to protect himself, and he needs donald trump to do that. so i think both trump and giuliani need each other very much. i think that's probably why you're going to see giuliani taking a different strategy from michael cohen, after a very similar extraordinary raid, because giuliani needs the protection of presidential privilege. he only gets that if he remains in the good graces of former president trump. >> david, what do we know about the degree to which the former president and rudy giulia

i represented michael cohen who i know will be on later and michael avenatti, both of whom had their offices raided. and there is a lot of steps in the process. i was on the other side for many years of the u.s. attorney's office. i had to sign off on these kinds of warrants. and the u.s. attorney has to sign off. the assistant attorney general and the deputy. and these almost assuredly line up to the level of the attorney general. so it is a very big deal. typically the standard is probably cause. in this case there was no doubt a much higher standard. i don't know if it rises to beyond a reasonable doubt, but these lawyers at the u.s. attorneys office have been waiting a long time. they have run through all the paces. they have this locked down. >> yeah. >> so they are feeling very confident about this. >> let's -- let's drill on your point there just to be clear. in a standard situation, probably cause low, medium standard there is evidence of the crime in the place being searched, specific articulate facts. you're saying it is, in fact, practically a much higher standard, which m

cohen, and michael cohen was at one point the president's defender, just like rudy giuliani is, and he was also the president's attorney, just like rudy giuliani is, and there had to be some reason they would take this extraordinary step, as we saw like with michael cohen, when they felt they needed to, they had to be some good reason to do this. the previous justice department was very reluctant to do this. this is a different justice department. when you ask me how is donald trump reacting, i am sure he's in a rage about this because giuliani remains one of his last defenders, not only personally but also politically in terms of the rigged election and et cetera, et cetera. giuliani was out there on january 6th on that podium promoting the big lie. >> yeah, so john, given that giuliani played a key role in trump's big lie about the 2020 election, and do you see the same thing happening here, will this be painted as a deep state hit job? >> yes, but i think the force of that argument grows weaker over time. i want to step back for just a second and remind everybody the context here

this is more dramatic than raiding michael cohen's office, and that ended with michael cohen in prison. what crimes could they be investigating here that would be that serious that would merit such a dramatic action by the justice department? >> well, you know, they have to set that out in the search warrant affidavit in support of the warrants, so, you know, it would be great if you and i could read that. we don't know. what we do know is some of rudy giuliani's associates have been accused in the same court, the southern district of new york, of campaign finance violations, fraud donor violations. there's swirling questions with what might have gone on with respect tots payments, i'm spec late, about transfers of money from foreign individuals, foreign nationals into a campaign, presidential campaign or other campaigns. the there could be money laundering issues that go on when you have transfers of money based on, you know, false pretenses. some of what lev barn yaz and igor fruman are fraud with respect to this company, a fraud guarantee. i don't know if it's true or not or whether

they did it with michael cohen. this does happen sometimes, but there is a threshold they have to meet. >> that's right. there's a threshold they have to meet, and they have to convince a judge there's enough probable evidence of a crime to warrant this kind of extraordinary step. again, as you know, this was taken on another lawyer, really where this all began with michael cohen a couple of years ago. this was also taken on victoria toensing. she was another lawyer. again, she only worked briefly for president trump. she was working closely with rudy giuliani on other issues. it does suggest a big escalation moving forward in this case. i should note one other thing that happened. rudy giuliani's personal assistant was subpoenaed to testify before a grand jury. that's a big deal because it's just a human interview and allowing for fresh information, but it suggests that it's not simply restricted to activity rudy giuliani himself was doing but what could have been done on his behalf. any way you look at it, this is

we've seen this once before with the investigation of michael cohen. these warrants are typically executed well along in an investigation. there was about a four-month gap between the cohen raid and the day of the charges against cohen. so it's certainly more than days away, but it's not years away. and i think it signals a high likelihood of very serious jeopardy for mr. giuliani because of the standards you have to satisfy to get a judge to authorize this kind of a warrant. >> look, the atmospherics here aren't good. mary, that's never been your specific sbinterest, you're abo the law not the politics. but he's got his son pleading his case. he's got michael cohen being a tea leaf reader, one of the least credible people you can 235 find. so that's not great for him that that's the company he's in at this point. well, there's the suggestion that this is just about registering as an agent. why do we all assume that's all this could be? do you believe that it could only be about registering as an agent? why would the search warrant involve going after

former trump attorney, michael cohen, has said that he is cooperating with multiple government agencies. back in 2019, when he testified before congress, cohen insisted he was witness to multiple instances of criminality. >> he was a presidential candidate, who knew that roger stone was talking with julian assange about a wikileaks drop on democratic national committee e-mails. mr. trump knew of and directed the trump moscow negotiations throughout the campaign and lied about it. you need to know that mr. trump's personal lawyers reviewed and edited my statement to congress. >> and who were the family members that you briefed on the trump tower moscow project? >> donald trump jr. and ivanka trump. the president of the united states, thus wrote a personal check for the payment of hush money, as part of a criminal scheme to violate campaign finance laws. i concluded that don jr. was referring to that june 2016 trump tower meeting about dirt on hillary, with the russian representatives when he walked behind his dad's desk that day. and that mr. trump knew that was the meeting that don jr.
