is that how it's done in north carolina? >> hey, joy. thank you for having me on here. you know, it is a disturbing video to watch. one of the issues that we talk about a lot in north carolina and across the country is militarization of police. when is that necessary? it is sad this case was based on a law. this was not murder, robbery, rape. this was drug offense. it's a double edge sword. sometimes police officers go in with use of force hoping that it will deter any use of force and sometimes it doesn't. they use these teams, that's an issue that needs to be examined across america. >> ben, the family, the attorneys, had asked attorney womble to recuse himself sending a ledder he needed to. the conflict is well defined with the sheriff's office. what does that mean, well defined with the sheriff's office and why did you want him recused? >> well, because, obviously, this is a local district attorney who works on a systematic and regular basis with the local sheriff's basis. there are housed in the same building together. we thought to remove any hint of impropriety t

let's talk about north carolina. i want to pull up this map. it's north carolina's former 12th district. once the most gerrymandered district in the u.s. can you talk us through how a district ends up looking like what you are seeing there in the bright green? >> sure. well, what republicans do is they pack a democratic voters into as few seats as possible. so that the voters that tend to vote democratic are in just a handful of seats. and in north carolina, for the vast majority of the decade, you have had ten republican seats and three democratic seats, because of that packing of voters, particularly voters of color, into as few seats as possible. so that they essentially give, you know, they make those seats very safe and take the rest of the state to be safe republican seats for themselves. in a state like north carolina, which as we all know, is a 50/50 state by all standards, you have a congressional delegation that was ten republicans and three democrats. regardless of what the voters wanted in that state. we actually filed a lawsuit --

that's not the facts involved in this case in north carolina. we don't have a high speed chase. we have an individual who's sitting in his car, who is unarmed, who they're serving a search warrant on, and we know there's so many other alternatives, including the alternatives that are identified in the use -- the manual given to police officers in this state, which are like many police officers' manuals that prohibit or in many ways discourage police officers from shooting into a moving vehicle. and we heard this district attorney say he's aware of those police policies but yet he did not take them into consideration in making his determination. so lots of issues with his defiance, as you described it, i think that's appropriate, and his ultimate factual and legal determination about the justification for the shooting. >> so walk us through this from the perspective of someone who's risked his life in situations like this, the prosecutor was making the case they had witness testimony that mr. brown was a drug dealer, including in the days up to the -- deciding to serve the arrest

. >>> in north carolina today, the family of andrew brown jr. said he did nothing wrong after viewing some of the police body cam video showing brown's deadly encounter with sheriff's deputies last month. kerry sanders is there for us tonight. >> reporter: andrew brown's family and attorneys say they got a clearer idea what happened when the 42-year-old was shot and killed by deputies almost three weeks ago in elizabeth city, north carolina. >> what we saw on that video was an unjustified killing. >> reporter: following days of protests, a judge ordered the sheriff to allow the family and their attorney to view 18 minutes and 40 seconds of 118 minutes of video recorded by deputies. >> we were able to see mr. brown sitting in his vehicle as he was ambushed, as the sheriff's office made their way to his residence, appearing to be surprised, appears he was possibly on the phone. at all times his hands were visible. at all times, you could see he was not a threat he wasn't in the wrong. at all what's in the dark will come to the light. >> reporter:
