nbc's stephanie gosk is at cosby's home in elkins park, pennsylvania with mar >> reporter: bill cosby woke up here this morning in his own bed in his own home a free man. his record is clean. he cannot be retried on these charges. the pennsylvania supreme court overturning his conviction from 2018 hinging on a procedural issue. they say his due process was violated. bruce castor, the district attorney back in 2005 who investigated this case decided not to bring charges after andrea constand accused bill cosby of sexually assaulting her, he then told cosby he was not going to prosecute. cosby went on to give a deposition in a civil case that constand had brought, in that deposition incriminating himself. fast forward ten years later, a new district attorney used that deposition as part of the basis to charge bill cosby again. the pennsylvania supreme court calling that decision fundamentally unfair. prosecutors and accusers say that doesn't change the underlying facts of the case while cosby's legal team is calling this justice. stephanie gosk, nbc news, elkins park, pennsylvania. >> n

so bill cosby spent roughly a day in his pennsylvania home before he was off again. we're learning more about the last 24 hours from his long-time spokesperson andrew wyatt who tells us the family knew there was a decision going to be coming from the pennsylvania supreme court. they just didn't know what it was or when exactly it was going to happen. he tells us that cosby was in his cell in a maximum security prison in pennsylvania, that he was actually asleep. the guards came roughly around 12, opened up the cell door and said you're free the pennsylvania supreme court threw out his conviction now the district attorney at the time bruce castor said there was not enough evidence to actually prosecute him at the time. so instead, he said he made a promise that he wasn't going to prosecute so that it would compel cosby to give a deposition in the civil case that constand was filing >> i found another solution to get a positive outcome for the complaining witness. to the day the case hasn't gotten any better. just because 80 people came forward and said they were moles
