that's the battle shaping up in the fraud trial of sunny balwani, the partner of elizabeth holmes at theranos. more today from one of the company's lab directors today. scott budman joins us live after spending the day in the courtroom. >> we saw both sides of the balwani story play out in court today. on the one hand, the prosecution saying he was a leader helping to run the company. on the other hand, his defense team saying he was merely an employee watching from the sidelines. with former theranos lab director mark pan dori back on the stand, we got a a better idea both where the prosecution and defense teams are likely to go in the trial of sunny balwani. for example, prosecutors rolled out several emails from balwani two theranos executives and other employees about the company's blood testing devices, trying to establish that he was making executive decisions. >> what they were trying to get these witnesses to say about elizabeth holmes, they're trying to get them to say the same thing about sunny balwani. >> reporter: on the other hand, balwani's defense team painting him as

today, prosecutors and the defense again sparred about sunny balwani's role at theranos. he is on trial for fraud and the two sides are trying to paint very different pictures of his role. our business and tech reporter scott budman was in court again today. he is now live with the latest. scott? >> reporter: well, good evening, garvin. it's become clear that the prosecution in the case largely calling many of the same witnesses we heard from in the elizabeth holmes' trial is trying to paint sunny balwani has very involved in the day-to-day operations of theranos. on the other hand, we started to hear from balwani's defense team which is trying to convince jurors it was really elizabeth holmes calling the shots. and that balwani was more of an investor, providing money and occasional advice to the eventually-doomed company. experts say that could be a tough sell as we are already seeing e-mails and hearing testimony from theranos employees describing balwani as very involved. >> the defense is going to have to prove that while sunny balwani was ultimately in charge of ope
