let's bring in david henderson now, civil rights attorney, cnbc contributor. david, this guy has already pleaded guilty how should lawyers on both sides approach this? >> you know, shep, he's pled guilty but it's still going to be a lengthy trial i think the lawyers need to approach it in terms of making sure that these families don't have to go through this trial twice. if you're the prosecutor in this case, you're not worried about the evidence but this case is so strong you don't want to make a mistake that leads to having to retry this where people have to relive the experience. if you're the defense, you're largely doing the same thing, making sure you're putting forth to the jury the reasons why they might give him life without parole instead of the death penalty. >> is it hard, david, to pick a jury in this kind of a situation? >> picking juries in capital cases takes a long time, period. i tried one here in texas in a case that was not highly publicized and it took six weeks. part of the reason why is because society is starting to gradually move away
