howard: for all the breathless coverage here, isn't it likely that mccarthy and jim jordan and andy biggs and mo brooks and scott perry will just run out the clock through the end of the year, and how much of it is about building calm for the early june hearings by this committee which has been doing this and leaking stuff for so long? >> you nailed it. democrats would love this to be the teleno novella of the summer, but the truth is people are concerned about the economy and other things. i don't know that they get to what they really want to, and i think at the end of the day i'm not so sure guys won't run out the clock anyway and have this go away in 2023. howard: right. basically go nowhere. >> that's right. howard: on the other hand, so much has come out about the committee's investigation. some of it released, some of it reeked. -- leaked. i wonder how much new will be there once they get under the bright lights in. >> what's interesting here and what's interesting in the rest of the country, if you ask a thousand people are you thinking about that, are you concerned about that? it

the committee has said they want to ask andy biggs what he knows about the purposes, planning, and expectations for that day. then there's mo brooks, the guy you saw in the video asking if they want to sacrifice for blood and kick some ass. the committee like lly wants to talk to him about that and an interview where the president asked him to quote, rescind the election of 2020. i spoke with kaitlan collins. what are you learning tonight? >> we're learning that v investigators have issued a subpoena to the national archives to get access to these classified documents that were taken to mar-a-lago after he left office. the national archives first found out about the documents back in january and once they were returned to the national archives, some were marked as classified. so what we're learning from the subpoena that's been issued that we've confirmed here is that this is the first signal there is some kind of ongoing investigation underway into the handling of this information. the subpoena is really the formal step taken by the justice department and investigators so they can get access t

the committee says that arizona lawmaker andy biggs, worked with state officials that the election was stolen. he also was alleged to be part of the january 6th insurrection and try to stop the counting of electoral votes. south carolina law maker told rally members on january 6th to quote, start taking down names and kicking ass. the problem with that, he stated that trump asked him to rescind the 2020 election. finally, though a bevy of leaked audio recordings exist, we know that house speaker kevin mccarthy baird responsibility for the attack. the committee says, the top republicans spoke with trump before, during, and after the insurrection. they want to know what he had to say. is not every day that we see members of congress get subpoenaed by congress. it feels unprecedented. as jamie raskin says, so was the insurrection. >> an attempted coup and a violent insurrection at the capitol, interrupted the trees will pass for transfer of power and they are unprecedented events. people have asked, does this issue a president for those in the future if there are coups and insurrections?

so these three gop lawmakers are congressman andy biggs of arizona, mo brooks of alabama, ronny jackson of texas. and that brings our total to six republican lawmakers in total including kevin mccarthy who the january 6 committee wants to talk to. unfortunately for the committee, almost all of those requests have been refused by the individuals. now, that is pretty remarkable considering the fact that some members of trump's own family have come in voluntarily and provided information. but these lawmakers making it clear that they view the committee's investigation as a witch hunt and they have no interest in participating in the investigation itself. now, what is interesting about these letters though, they do reveal new information about where the committee is in the course of its investigation. it mentions recent testimony that was provided by white house personnel where congressman bibig s bigss oig' name was mentioned. and so we're getting a sense of how far along the committee is in its investigation and how much trump's influence is really impacting the potential cooperation from

scott perry, jim jordan, andy biggs, paul gosar, mo brooks, matt gaetz, jody hice, marjorie taylor greene, louis gohmert and lauren boebert. do you think that some of what kevin mccarthy or do you know that kevin mccarthy didn't possess as much knowledge of his own caucus participating in that high-level inner circle coup plot? do you think that's one of the things he learned before he had that reversal of views on trump's role? >> well, i don't know. he has not yet come in to talk to us, although he should. he did, on one of those tapes that i heard on the news, along with everyone else, express concern about some of the members of the republican conference who could be inciting violence, so at least he was aware of that, apparently. but i don't know what goes through kevin mccarthy's mind. there's certainly a lot of questions that we should hear from him about. and we're hoping that he will come in. we expect him to come in. and we are reviewing our options to make sure that he does. >> can you complete a full and thorough investigation without understanding what kevin mccarthy knew at

they are house minority leader kevin mccarthy, congressman andy biggs of arizona, congressman mo brooks of alabama and congressman jim jordan of ohio. >> these are people who were involved in discussions with the president. they were in communication with the white house staff. on january 6th leading up to it, somewhere involved in the effort to overturn the election. some spoke at the rally before the attack. one has said publicly the president called him to reskrend is election. they clearly have relevant testimony. they need to do their duty and uphold their oath and come in voluntarily. >> minority leader mccarthy would not tell leaders whether he would ply splooi kplooi. let's bring in senior legal analyst elie honig. david, let me start with you and the plausibility that any one of these five will sit down and provide anything more to this committee. >> i don't know how to do a plausibility scale here, but i don't think it's going to go seamlessly. i don't think the subpoena is going to be answered affirmatively and they're going to go in. i think this is going to be a prolonged p

biggs, and mo brooks. i mean this is an unprecedented move. give me your reaction to the committee subpoenaing its own colleagues. >> well, as a former chair of the house ethics committee, we actually did authorize the issuance of some subpoenas to members at various times. it was always for documents. i don't think we actually ever issued the subpoenas, but we authorized them. senator bob packwood, he was subpoenaed for documents. he went to court and packwood lost. what's unusual is members are being asked to provide testimony under a subpoena, and so i suspect these members will not comply and then if the house flips, i suspect they'll return the favor and they will issue subpoenas to their favorite targets, maybe adam schiff or someone like that. but this is -- i think it's bad for congress at the end of the day because, you know, if these subpoenas are defied by the members, you know, it just weakens congress. so i think that's really what's happening here. >> he didn't say it, but i could hear it, jo

biggs of arizona. the committee wants to know more about mccarthy's conversations with former president donald trump during the attack and meetings. the other 4 men had with trump in the days before january 6. the committee says it's important to get every piece of information it can about the attack so far more than 1000 witnesses have been interviewed, including other republican members of congress and some of former president trump's own children. i have every reason to believe that. >> people are today will comply with legal duty. and i would say to walk rate, our congress and on the political institutions country might be on. the committee has not changed. >> they're not conducting they just want to go after their political opponent. now, there is some risk for democrats in issuing these subpoenas. republicans have said publicly if they retake the house this fall after the midterms, they planned to shut this investigation down. if it hasn't been completed. >> republicans also have vowed retributio
