john avlon at the magic wall. john, what do you have for us? >> i just want to hammer home what a crushing this is. we've been looking at the republican race for senate all night. it's too close to call. three candidates splitting it up. john fetterman from a hospital bedouining almost 60% of the vote. conor lamb, centrist congressman around allegheny county, beaver county that fetterman is from, people thought he would make a classic general election candidate. fetterman knocked him across the board. so you got basically a unified democratic party around fetterman for senate, around shapiro for governor. in contrast to this very fractured republican party. fetterman doesn't neatly fit the boxes. he is very progressive on policy, but he has this kind of blue collar populist persona. it's going to be a fascinating race. you got to say fetterman's team crushed it tonight. this is a pretty unified democratic party heading into the fall against the tough headwinds of a pendulum swing towards the republican party in midterms. >> thank you there, sir

john avlon is at the magic wall for us. john, i asked jeff zeleny, mehmet oz is hopeful. he believes he can pull it off. can he? >> he sure can. look, this thing is tight as a tick. take a look at this. 2,600 votes. 86% in. votes outstanding all over the place. but if you want evidence that kathy barnette could be acting as a spoiler for oz after the trump endorsement, take a look at places where kathy barnette's in first place, like montgomery county. now this is her home county. it's the third largest county in pennsylvania. oz is in second place. so you see there's evidence that they're eating into each other's bases. and if you add those two numbers up of course mccormick's in a distant third. but mccormick may have been able to come through the middle. take a look where he's rising which is surprising. rural counties. traditionally rural counties are the heart of trump country, especially in a state like pennsylvania. mccormick outperforming in a lot of these rural counties. also something interesting to take a look at. this is coal country. now, dr. oz is performing

cupp, and john avlon. all right, split decision, john. so what's the takeaway? >> it's a split decision. i mean, look, you know, west virginia does speak to trump's control over the appeared. the fact that an incumbent who backed infrastructure, who stood up to trump got pretty trounced speaks to the fact that when it's a partisan state and a partisan primary, trump's going to have the inside lane. and that cross-endorsement from joe manchin isn't going to help, even for a guy who was previously the republican head of maryland. but nebraska in some ways is the bigger take, right? bigger state, higher turnout, incumbent governor going up against donald trump and defeating him. that's crucial. so that shows that trump can be taken on. but this is still a party where donald trump has a cult-like control over primary voters. nebraska is an outlier right now. pennsylvania, as you said, will be the real test. >> s.e., what do you think? >> kitditto to everything that n just said and i'll add that trump has had more of a mixed bag endorsing governors. those are differe

john avlon with a reality check. >> that's right. the gun debate, reignited after the massacre of kids and teachers in their texas school is also reminding americans about the deep dysfunction of our polarized political system. because we can have common sense gun safety reforms supported by a super majority of americans. like 87% for preventing people with mental illness for purchasing guns and still there is this sense that nothing is going to get done in congress. but it is evidence of the anti-majority senate structure in our politics, a direct result of a declining competitive congressional districts, and that's by design. get this, the number of swing seats in the house fell from 164 in 1997 to just 78 in 2021, according to the political report, which now lists just 32 seats as tossups. that means the vast, vast majority of the 335 house seats are effectively decided in these low turnout largely close partisan elections that don't represent anything close to a majority of constituents. this doesn't make sense, right? unless you

i want to go straight away to cnn legal analyst and supreme court byographer, and analyst, john avlon. we've got news about the chief justice john roberts and his apparent dissent from justice alito's draft opinion. tell us about it. >> yeah, thanks, don. just to mention how stunning it is that politico would publish this draft opinion which we have not authenticated but it jives with what we know about what's been going on behind the scenes at least in a preliminary way, and what we know independently from our own sources is that chief justice john roberts would be dissenting from this opinion. he was not prepared to overturn roe v. wade, to roll back a half century of precedent. he's never been in favor of abortion rights generally, but it's just so staggering to remove the right to abortion and for many institutional and other reasons, the chief was not planning to join this opinion as far as we know. he was, however, don, ready to uphold the mississippi law that was in dispute before the justices, which is a 15-week ban on abortion, ban on abortion at 5 weeks of pregnancy, so what

avlon. i want to start with the governor's race there in georgia. number one, trump bet big on david perdue. when you bet big, you risk losing big. and the other thing, and this is what i want to start it this very public performance by mike pence. this very public split from donald trump where he shows up on the eve of the election and does this rally. let's talk about mike pence, maggie, what exactly is he doing? >> he's making clear there is separation from donald trump. mike pence is trying to position himself potentially from donald trump without the baggage, without the drama. there's no clear way to do that, in georgia where this was a focal point of donald trump in 2020 to try to subvert the election victory for joe biden, you put up against donald trump as a torpedo and it's failed pretty badly. mens is not coming in early in the race, pence is coming in, in the end. it's something of a thumb in trump's eye, i think pence's people would deny that. >> it's you show up on election eve
