we have a couple of recordings of kevin mccarthy. but you know, his day is full of conversations, i'm sure, that entire month of january, all about this. who did he talk to? what did they say? and the committee may have some of that information from the other side of those conversations. so, they have to be careful, and they also have to be wary of ethics investigations, of being pulled from their committees, but also just undermining their own authority in whether or not they want to comply with the subpoena from their own body of congress. >> let me interrupt you. >> so there's a lot at stake. >> with something that might change this entire conversation. this could be a game changer. "the new york times" has just broken the story that the justice department has requested transcripts from the january 6th committee. so, it may be, dan goldman, that it isn't just the 1/6 committee. it isn't just their own colleagues who want to know what they saw, what they did, what they texted, and what they knew about january 6th. it may be the uni

what's more are you trying to obtain from kevin mccarthy through testimony? >> well, you're right, we do know a lot about this. but most of what we know, much of what we know, we are here secondhand. and of course, no one would be better position to testify about conversations that he had with donald trump than kevin mccarthy. and indeed, he's making reference there to what he would tell the president. what's in fact did he say over the phone with the president? what was the president saying to him on january 6th, we are hearing from other members as we did earlier from -- butler that the president irritated with mccarthy when mccarthy was begging to call it off said these people who are attacking the capitol apparently care more about the election than he does. or worse to that effect. so there is a lot we would like to ask mccarthy. these other members we subpoena today, some allegedly involved or were involved in seeking pardons. why do they think parties would be necessary? or were involved in an effort to overturn the election that they -- judge of calif

kevin mccarthy, for example, told republicans privately that donald trump had actually admitted some responsibility for the attack and it's obviously very different than what we heard publicly. but, look, none of them have said whether they would comply yet with the subpoenas, i think they have offered some hints, they've called this a witch-hunt, illegitimate. let me read you what kevin mccarthy told us yesterday, he said my view on the committee has not changed, they are not conducting a legitimate investigation, they just want to go after their political opponents. so it seemed pretty unlikely that they're going to comply and the question becomes how does the committee enforce these subpoenas? they could refer it to the doj for a criminal referral, this he could make a referral to the ethics committee which doesn't have a lot of teeth, but so far the committee is keeping a tight lip about what the next steps are. >> that seems it would take some time to have that fight, we are six months out from the midterm election so that obviously is a factor. that definitely does not sound li

you can have kevin mccarthy testify and refute any of this if it isn't accurate. he chose to commit the crime himself of contempt of congress, rather than being here sitting in the chair and telling the american people what he knew. we will hunt hit -- hold him accountable for this cover-up. >> politico is reporting that the january 6th committee has heard testimony that mark meadows burned papers in his office after meeting with scott perry. this is in weeks following the election. this follows a familiar pattern. the trump white house, where record keeping officials reported that they had to regulate with scotch tape to reconstruct papers from donald trump. mark meadows has his finger prints on everything here. do you think the doj is trying to give him a lesser sentence for his cooperation. >> -- that was 170 days ago. he has yet to be prosecuted. i have to believe that the doj is looking at him or larger criminal caucuses for negotiation to get him in front of this justice frame. it is gathering speed. with mark meadows getting rid of paper in the fireplace an

what we're seeing is this two different kevin mccarthys and i wonder if he gets away with it. >> well, clearly he does. trump has forgiven him for now, part of the reason is because since that moment, kevin mccarthy has done everything to get back in trump's good graces. but that audio is really striking to me because he is shooting down the idea of the 25th amendment, not because he doesn't think trump doesn't deserve it, he says it would take too long. the same with impeachment. in audio, he talks about how he doesn't think impeachment is the right option, it would be too divisive for the country. he says what trump did was absolutely atrocious. very different than the kevin mccarthy we hear today. >> the audio indicates he's already moving on, he's moving on to president biden who is about to be inaugurated. he says in the audio he hopes for a smooth transition of power to president biden. so is there any sense of any blowback from all of these recordings? >> well, the biden piece is interesting. you get the sense mccarthy almost feels the responsibility to make it right. and he's

and if kevin mccarthy was ever speaker of the house, there is no backstop. there's no integrity that would protect against him going all in with the next coup attempt. >> congressman, you were at the capitol on january 6th. what questions do you want answered during the committee's public hearings next month? >> there's a real gap around what donald trump knew, as far as potential violence, and the days leading up to it. we know that he incited that violence because he said just 20 or so days before the attack, that it will be wild. and yet, you have to come fight for your country. you won't have a country anymore. but what did he receive about warning of the proud boys and the oath keepers and the other violent groups. what's funding that he and his allies provide? and of course, during the attack, what did he know, and what did he not do that could have saved more officers from the injuries they suffered, and our democracy from nearly losing everything? >> congressman, what do you see as the stakes of these hearings, both for democrats, republicans, for ou

kevin mccarthy is going to try next. the larger issue is trying to govern a caucus that's ungovernable as we get the book, which is out tuesday. this is a party now which is just very difficult to contain, and trump obviously is a huge driver of that. >> there's also just such a difference between being house speaker, and being a powerful house speaker there's no telling right now whether he is for sure going to be able to continue -- you know, maintain the support that he seems to have now, become a house speaker eventually if republicans take the house. but there are real questions about what kind of power will he have as the leader of the conference. he's going to be potentially more be-holden to donald trump, than he has been in the past. he might also feel like he owes certain things to members of his own conference. and then i think, not to be, you know, underreported, is sort of the dynamic that this -- all of this reporting has created between mccarthy, and members of the media that cover him day and and day out

minority leader kevin mccarthy of california. and of course, that is the guy who is poised to become speaker of the house, should republicans win the house in the midterm elections. they also issued subpoenas for four of his colleagues, and in fact, their colleagues. jim jordan of ohio, mel brooks of alabama, andy biggs of arizona, and scott perry of pennsylvania. the latter four in particular are largely believed to have been key players in the ex presidents plot to overturn the 2020 election. in case it is not clear, this is obviously a really, really big deal. we sort of dug back through the history here as far as we can tell, this appears to be the first time a member serving in congress has been subpoenaed by congress outside of an ethics investigation. let alone the man gearing up to be speaker. and for months and months, house democrats have been trying everything to avoid getting too precise at this point. which is why it is worth looking back at just how we got here. in the days after the insurrection, it really seemed l

>> not the kevin mccarthy side of it. he seems to have weathered the storm on this. i was texting with the republican chief of staff after the tapes came out and "washington post" reported that trump was okay with it and then the chief of staff said then we're okay with it. they were happy to move on. the book reflects the private conversations people were having before january 6th, on that day or around that day, are now coming to light but were discussed in the hallways for the last two years. >> steve hays, this anecdote, it is what we thought it was. about power. >> reading the book is an emotional experience for those who have been covering this for a long time because you see all the republicans are saying one thing behind the scenes and something totally different when the cameras go on. sometimes within minutes of those two statements. i guess i have a slightly different take. i think mccarthy is okay in the short-term but i think in the medium and long-term, this causes him trouble. he already had some moderates and movement conservatives who are frustrated

i think especially for mccarthy in the wake of the tape made public of kevin mccarthy talking about possibly asking donald trump to resign after january 6th. i think mccarthy is going to have to dig in here in his mind. he clearly knows a lot and he doesn't want to talk about it and i don't expect a lot of voluntary cooperation. >> this certainly does put congress in some uncharted territory as jamie just said. it's unprecedented what they're doing. will the select committee have to make some very tough choices about how hard to pursue their testimony? >> i think they will, wolf. i think they're going to have to, you know, look at whether they want to try to keep fighting if these guys resist these subpoenas. it's the likeliest outcome. if these guys decide to dig in and not comply with subpoenas from their own colleagues, the own body they serve in, then the committee is going to have to decide how hard they want to push it. as jamie said, this was not a decision that was reached lightly. it took the committee a long time to get here, but i think you're seeing across several fronts, this co

minority leader kevin mccarthy of california. and of course, that is the guy who is poised to become speaker of the house, should republicans win the house in the midterm elections. they also issued subpoenas for four of his colleagues, and in fact, their colleagues. jim jordan of ohio, mel brooks of alabama, andy biggs of arizona, and scott perry of pennsylvania. the latter four in particular are largely believed to have been key players in the ex presidents plot to overturn the 2020 election. in case it is not clear, this is obviously a really, really big deal. we sort of dug back through the history here as far as we can tell, this appears to be the first time a member serving in congress has been subpoenaed by congress outside of an ethics investigation. let alone the man geup

>> reporter: if you're kevin mccarthy, you're hoping there are zero more tapes. the new york times reported on a number of private conversations that he had about donald trump in the days after january 6th. and what is striking to me, ana, is just how serious the conversations were in the upper levels of gop leadership about removing trump from office. whether that was asking him to resign, invoking the 25th amendment, or impeachment. kevin mccarthy did rule out impeachment. it's not because he didn't think trump would deserved it. with the 25th amendment, he thought it would take too long, and impeachment he thought was too deviivisive for the country. so far he has weathered the storm here, and a big reason for that is because donald trump has remained firmly in his corner. they met just this week and have a good relationship. and another reason is that a lot of republicans privately felt exactly like kevin mccarthy after january 6th. they're not keen to hold this against him. >> we know you will keep us posted. thank you so much, melanie. >>> to another lawmak
