minority leader kevin mccarthy of california. and of course, that is the guy who is poised to become speaker of the house, should republicans win the house in the midterm elections. they also issued subpoenas for four of his colleagues, and in fact, their colleagues. jim jordan of ohio, mel brooks of alabama, andy biggs of arizona, and scott perry of pennsylvania. the latter four in particular are largely believed to have been key players in the ex presidents plot to overturn the 2020 election. in case it is not clear, this is obviously a really, really big deal. we sort of dug back through the history here as far as we can tell, this appears to be the first time a member serving in congress has been subpoenaed by congress outside of an ethics investigation. let alone the man gearing up to be speaker. and for months and months, house democrats have been trying everything to avoid getting too precise at this point. which is why it is worth looking back at just how we got here. in the days after the insurrection, it really seemed l

we hear mccarthy discuss this and dismiss it as a possibility. but it's interesting as to why he dismisses it. let's take a listen. >> i think the options that have been cited by the democrats so far are the 25th amendment, which is not exactly an elegant solution here. that takes too long, too. it could go back to the house, right? >> that takes too long. the audio shows the 25th amendment was under serious consideration, alex. >> that's right. this is something we have reported from a couple top republicans in the book. the 25th amendment was sincerely and seriously in play at this point. and a whole lot of republicans like to sort of hand wave, people like to speculate about the 25th. jake, this was a whole lot more than speculation. as your viewers just heard. you don't hear kevin mccarthy saying in that moment, you know, i don't think it would be appropriate to invoke the 25th amendment. or i'm not sure it was designed for a situation like this. his concern is it would take too long. the reason he's worried it could take too long is the cabi

what else are we hearing in mccarthy's own words? >> well, what is so fascinating about this audio, erin, is just how blunt the house minority leader was about the former president's conduct in the time after january 6th. and he seemed to agree that there needed to be some sort of mechanism to remove him from office, but he wasn't sure that there would be enough time to do it, or if there was a path that would do it in an artful enough way to make it easy for the country to move past this. listen to this other piece of audio where he discusses other options on the table. >> reporter: so what's remarkable about these comments, it's pretty different than what we saw from kevin mccarthy in the days leading after january 6th. of course, he did go to the house there are and condemn the former president, but that was brief. after that, he was a forceful defender of the president throughout the impeachment trial and the days after. this shows behind closed doors he recognized how serious the situation was, that he was upset with the way the

so, what exactly was mccarthy heard saying this time? >> reporter: anderson, this audio is the latest in a series of recordings that reveal what the gop leader was saying privately to other house republicans in the wake of january 6th. in this latest recording, mccarthy is heard discussing the 25th amendment. to put this in context, in the aftermath of january 6th, a number of democrats, including members of leadership, publicly called for former president trump to be removed from office either through impeachment or the 25th amendment to the constitution. that would have required then vice president mike pence and the majority of the trump cabinet to vote to remove the president from office due to inability to discharge the powers and abilities of his office. that would have been an unprecedented move. this audio was shared with cnn. let's take a listen to this short clip. >> i think the options have been cited by the democrats so far are the 25th amendment, which is not exactly an elegant solution here. >> that takes too long too. >> s

he hated mccarthy and despised mccarthy. mccarthy had become powerful. there was an attack on general marshall, and it was extraordinary. i quote some of it in the book, and people remember just a couple of lines. it was pretty insane, some of the things he said. the idea that marshall is at the root of everything. it's extraordinary and crazy. i don't know whether mccarthy -- there's been a number of books about mccarthy, too. and i think richard revere wrote the line that he saw anti communism as a great oil, it came up a gusher and he went for it. i think he began to truly believe this stuff. he was very popular. but then it became more serious. he was the villain of cartoons. and then he began to chart a path to his own destruction. >> he certainly had an effect on herbert hoover by bringing him to the oval office. hoover is known, he was given some help in europe, which was something he had done before as well. he was asked to do that. and hoover ran out of the oval office crying. >> yeah, truman was very generous that way. i don't know the whole st

kevin mccarthy. it is predicted that in the 2022 midterms republicans will take back the house and we're expecting retaliation from republicans should they gain the majority in the house, things that we could expect would be preparing for committee removes, retaliatory subpoenas and even impeachments from house republicans should they win back the majority in the house. so really of course it is unclear whether these republicans will comply to the subpoena. they have not said yet. of course it is a subpoena, this is the power that the house select committee has and they will have to see what ends up happening with the fact that they have the subpoena to appear before the committee. but really the bottom line here is it is a long time before now and the 2022 midterms and a lot could change before then. >> there has been a lot of process around the january 6 investigation, but this is a really big deal, right, when you've got congress going after its own. >> reporter: that's right. kevin mccarthy calle

mccarthy, biggs, gosar, all of these members had different roles. you had scott perry who was coordinating with the doj directly, propagating conspiracy theories, encouraging the hiring of jeffrey clark and the ousting of jeffrey rosen. you have mccarthy, who was in touch with the president on that day repeatedly, to then go and sort of turn his back on the house gop conference by posing with trump a week after the insurrection, after privately calling to invoke the 25th amendment. so all of these members had very different roles in terms of how they contributed to the events of january 6th. and they're not necessarily central for lawmakers trying to wrap up the investigation. but i think there's a sense here that politically this was needed and to give them a chance to respond to a lot of the evidence that they've already collected sort of corroborating the roles around these members who have so far refused to voluntarily comply. >> yeah, perry's the one i'm particularly interested in. he was someone they reached out to early and seems so central i

kevin mccarthy is going to try next. the larger issue is trying to govern a caucus that's ungovernable as we get the book, which is out tuesday. this is a party now which is just very difficult to contain, and trump obviously is a huge driver of that. >> there's also just such a difference between being house speaker, and being a powerful house speaker there's no telling right now whether he is for sure going to be able to continue -- you know, maintain the support that he seems to have now, become a house speaker eventually if republicans take the house. but there are real questions about what kind of power will he have as the leader of the conference. he's going to be potentially more be-holden to donald trump, than he has been in the past. he might also feel like he owes certain things to members of his own conference. and then i think, not to be, you know, underreported, is sort of the dynamic that this -- all of this reporting has created between mccarthy, and members of the media that cover him day and and day out

and here's the thing, let's take mccarthy as an example. we know that the j six committee asked mccarthy previously to appear voluntarily and provide the information he knows about donald donald trump's possible crimes, and he said no. but, the legal landscape has changed because we have had a federal judge in california, judge david carved her, rule as a matter of law he found that donald trump and john eastman committed to federal fentanyl in these together. and he found by a preponderance of the evidence. so now mccarthy has nowhere to run, because if he refuses to comply with the subpoena, in his zeal to conceal donald trump's crimes, he absolutely exposes himself to committing the crime of this person of a felony because, not only is the crime cognizable in the court of united states, but a judge has called nice did. and i had to look at that word to make sure with the appropriate past tense so mccarthy will be violating that federal statute if he continues to defy the subpoena and concealed all transcribes. >> i am writing down all th
