now only mr. bannon and mr. navarro indicted pursuant to the probe. the other two have not. hearings regarding the insurrection with regard to the january 6th committee begins next week. on this newsworthy night, two former prol prosecutors who know exactly how these cases work. john flannery and barbara mcquade. welcome to you both. john what is significant about how the justice department is dealing with mr. navarro, and did his conduct and actions contribute to the assertive arrest maneuver made today? >> -- peter navarro would have struck justice, made no bones about it, as recently as last night when you spoke with him, and then he is surprised he's arrested for what he's admitted to on the air? i think this indictment says, no, you don't get away with such acts. the nation needed this, because we need an accounting and gun a process to have that. >> hmm. barbara? >> yeah. i think, ari, the justice department would do well to have you simply imp vit peter navarro to come on your show. he's now come on your show at least three times and confessed to this crime. in a moti

there are ways that mr. navarro and mr. bannon and others have leaned into this as a kind of big brawl to show that they really don't believe in the validity of this committee. as pete just mentioned, the supreme court has referred to the validity of this committee. it cleared the way for some documents. that's not a legal question. you're not going to get out of this indictment by saying you don't like who runs the committee, which is what part of what mr. navarro's civil suit filed this week said. he brought that up in our interview, but how he responds to this in custody today, we'll have to wait and watch. >> let's get context. peter baker, you of course covered the trump administration. tell us more about navarro's role in that white house and maybe what this indictment might signal to other people who are of interest to the committee. >> yeah, peter navarro is an interesting figure in the trump white house. his title was trade and manufacturing adviser. but he roamed quite widely to anything that kind of caught his in

mr. navarro has made it simple. he could have marked it up. he could have avoided indictment, no doubt, by doing that. as mark meadows and dan scavino did. instead, he decided to maybe help him market his book, who knows. but to completely flooded the issued congressional subpoenas, and just ignore them. and assert this blanket claim of privilege, without as you point out, the former president invoking it. and when other judges have already held that it doesn't apply. and as a matter of law, all he had to do was go sit for his deposition, and invoke privilege, question after question, topic by topic. that, alone, could have avoided these two misdemeanor charges that he now faces. so, it's right. the judge is absolutely right. i couldn't agree more. this is pretty simple, pretty cut and dry, did he or did he not comply with these congressional subpoenas? a jury can decide, but it seems already cut and dry. >> and the committee wants to speak with him for the same reason that we've seen the evidence they have throughout these hearings, that peop

navarro and mr. bannon's situation as well as the prep for these hearings, was really the best i could observe in measurable ways confined to people who actually really regularly pay attention to this stuff, professionals, people involved, and people who are really interested in the news and a shout out to people interested in the news. but as a practical matter, a lot of other people are busy with inflation and post-covid life and the rest of everything. it wasn't always top of mind. it seems that, i want your analysis, is there a connection between what's happening in the bannon case and the sort of awareness of the validity -- i'm not saying the committee gets everything right. people make up their minds. the validity of the committee in court repeatedly upheld combined with 30 million plus americans actually seeing it do its work and seeing that it looks like some of the other things in d.c. pretty serious, pretty factual and the republicans involved seem to be there to participate rather than to

so, we are still trying to wrap our heads around all this means that the subpoena to mr. navarro by his own admission asked for documents, including his own communications with president trump himself and those are the questions you must ask them, under oath before a grand jury. he said this was tbd. i asked and whether he was going to comply with the subpoena, and he said this was tbd. >> it's striking that he is the first we know in this category i haven't missed something. there is no one else in the white house or the inner circle who appears to have gotten a subpoena of this kind? >> it's possible there is somebody and we haven't learned about it. this is who we have learned about. his case may be somewhat unique, he has a referral from the congress for contested contempt of congress. so, it's possible they are investigating him and these questions go beyond peter navarro. asking about conversations about president trump, their communications are trump about all the documents that he refused to turn over to the house committee that involved the green bay seat which y
