so there is the reaction in response now from susan collins' office. meantime collins write that she and senator lisa murkowski have introduced a senate bill to codify roe v. wade, this is important. their bill is very different from what the house passed earlier. it's different because apparently the house bill was too expansive for collins and murkowski and senator joe manchin. we have yet to hear from senator murkowski from alaska. we have not seen anything on her twitter account yet. i reached out for a statement. she's facing a very tough re-election in alaska. she just voted for gun reform. so this could also be dicey for her. >> martha: we remember that murkowski and collins were sort of the final two decision makers when it came to the kavanaugh nomination approval. murkowski did not support and collins did support. she gave a very impassioned speech on the floor of the senate to support him. thanks, aishah. let's bring in mike davis, the former law clerk for neil gorsuch. president of the article 3 project. mike, good to have you with us today

i understand there's more context available on susan collins' statement. >> shep, that's right. you are looking at a statement from somebody who herself supports abortion rights but also voted for gorsuch and kavanaugh to get on the supreme court. at the time she said she felt that both men suggested to her that roe was settled precedent in an interview with cnn, she said kavanaugh told her under oath many times as to me personally many times he considers roe to be precedent upon precedent because it was reaffirmed in casey versus planned parenthood she also didn't believe neil gorsuch she voted to confirm wanted to overturn roe v. wade she said i had a long discussion with justice gorsuch, he pointed out he is co-author of a book on precedent. now both men voted to overturn the precedent. collins says she was reassured they would not do. a lot of scrutiny now on susan collins, whether she was mislead in that moment, naive to believe the statements in the first place, and how she's going to respond now. obviously too late to take back votes to put those gentlemen on the supreme

clearly what brett kavanaugh said to susan collins was not the full story from where he sits. he wrote a concurring opinion yesterday, christi, where he acts as if, of course i was poised to overturn roe, of course i thought it was not solid precedent. he went through all the reasons of why the action he was taking yesterday was so correct, that it was time to roll back roe. and he didn't act at if this was some new epiphany he had. he outlined his view of precedent and why this particular precedent was egregiously wrong. so i believe he probably had some of those thoughts back when susan collins talked to him and he might have accentuated some open-endedness in his thinking. he did what he needed to do to get confirmed as many nominees have. it just is a reminder that senators cannot take things at face value and those of us watching the testimony of these nominees, it reinforces what many of us thought all along, it's kind of just talk, unfortunately. >> jennifer, do you agree with that? and not only do you agree with that, but where does this leave chief justice roberts? be

also in at least two instances you have susan collins, joe manchin, two very important votes, for one of those justices saying in two instances that they feel misled in their confirmation hearings and the private meetings. >> well, on the misleading question, i think the more interesting part of that is what susan collins has said she was told by justice kavanaugh privately. in terms of the hearings, everybody has to take with a grain of salt whatever the nominees say in their confirmation hearings about how they're going to rule in the future. you could even ask whether it's fair to ask potential judicial nominees how they would rule in specific cases in the future. it is a conservative super majority. it is flexing its muscles. it seems to be going at a very fast pace. the chief justice john roberts, for example, tried to tap on the brakes and try to get his colleagues to go along with a ruling that while it certainly would have eviscerated the roe protection wouldn't have opened the door to trigger laws but let's not go all the way. i think we'll see this conservative super majorit
