mar-a-lago, top secret classification. does that mean nothing was in them to begin with, they're being recycled? or does it mean maybe information of a top secret nature could actually be missing now and unaccounted for? >> yes, so that's certainly one of the unresolved questions here. and obviously i believe that's something the fbi would like to know is what was originally in there and when. it certainly could be the case that when they were packing up the white house to move everything to mar-a-lago, they just stuffed things into these folders that had nothing to do with classified information that they have previously been used in that manner, but weren't currently being done. but that's an unresolved issue that has to be clarified. the reason -- everybody is trying to figure out why donald trump would do this. donald trump is a notorious pack rack. he likes souvenirs. he thinks it's cool. he thinks this is stuff he can have and show off to friends at mar-a-lago. he has no understanding of what the security rules are o

we know mar-a-lago is his primary residence, and that is where he went, directly went, to mar-a-lago when he left the white house in january of 2021. that, of course, makes sense. most of the documents that would have went with him would have gone there. but do we think at this point that doj would have reason to search some of the other trump properties? and what do you think their hesitation would be? coming up on an election, it could be perceived as political? >> if i were an investigator, i'd be concerned these documents are at some of his other properties. you have to have probable cause that they are there before you can search. you can't engage in a fishing expedition. we don't know the reasons because of the redactions, but a judge found probable cause to believe documents would be at mar-a-lago. it wasn't just a hunch. it has to be facts. things like multiple people told us. it does say they needed to redact to protect the identities of a significant number of civilian witnesses. or they saw thing on surveillance video or other kinds of things that caused them to believe th

the former president is insisting he had the power to be the classified documents seized from his mar-a-lago home just by thinking about it. but did he? >>> plus, a revolt in russia, long lines to leave, as putin tries to ramp up his war in ukraine. the kremlin pin initialling pro punishing protesters forcing some to fight in the very war they want to stop. >>> and crisis of democracies, a warning to the world from french president macron, and his message to donald trump after being wrapped up in the mar-a-lago case. welcome to the lead. i'm pamela brown in for jake tapper. and we begin with our politics lead. and just in, special master of the trump mar-a-lago documents case opens the door to hearing witness testimony. this, coming after yet another legal defeat for former president donald trump. three judges from the 11th circuit court of appeals unanimously reversed district judge aleene cannon's decision. three-judge panel, one obama and three trump appointees. a special master's review of that subset, about 100 records is now partially stopped after judge cannon amended her ruling today

but again, mar-a-lago is a sieve. and again, thinking about foreign intelligence services that could easily get people into mar-a-lago, hey, there's to buy a membership or have somebody in a cleaning crew or something else. if those documents were left unsecured for that length of time, i am sure my national security colleagues and intelligence professionals who are trying to do this risk assessment right now are just in absolute shock in terms of the type of things that may have been exposed including the nuclear capabilities of foreign countries, whether it be adversaries or allies, this is among the most sensitive, the most highly restricted documents in the u.s. government, and the fact that donald trump cared not a whit about it, just underscores how irresponsible he has been as a president and afterward in these last 19 months or so. >> i wonder if you can explain why, there are nine, china, france, israel, north korea, there are more nuclear powers. can you explain why a country's nuclear capabilities or ambiti

were they recovered where else at mar-a-lago or are they gone? that would be of course the most concerning outcome. and then finally, if you can ascertain, if you're thinking about charging somebody, you need to know who handled them, who mishandled them, what they did with them and can you show the relevant intent and knowledge. for that you'd have to talk to your witnesses, probably want to look at that surveillance tape that doj subpoenaed. you might want to send some of the documents for fingerprinting or dna. so i think there's a whole bunch more questions raised by the new filing. >> that's just the empty folders there. carrie, you look at all the paperwork, there's so much material there. there's just a lot of material. >> there's a lot of material, it's a lot of documents. and remember, these documents belong to the united states government. and that's really the basic premise that is underlying all of this. i do think that the fact that so much of this information was classified, including lots of information at top secret levels, compar

in addition to those hundreds of classified documents they found at mar-a-lago after a representative for the former president represented that there were no more classified documents left at mar-a-lago, what really jumps out at me is by my count there are more than 10,000 government documents that donald trump was not supposed to possess, those are the documents, just the documents along that do not have any classification markings on them, but regardless of classification status here that's 10,000 documents that got -- donald trump possessed that he wasn't supposed to stored in these bins. all of these created during donald trump's presidency belong to the american people under the presidential records act. there is a reason we have that in place because post watergate and the richard nixon era. we need to have a record for history of what exactly went down. scholars will be studying the trump era for generations and the idea that he pilfered 10,000 government documents is sort of really significant here because those are documents that properly belong under the control of the natio

it's just really about their presence at mar-a-lago. >> simplest terms, there's only one president at a time who can claim that privilege. final question, if i can. in the pantheon of trump public statements, this one stood out yesterday, him openly offering or saying that he would look very, very seriously at full pardons -- his words there -- for those involved in the violent attack on the capitol, violent attack on law enforcement on january 6th. i asked jennifer rogers this question last hour. in her view, she said, it's hard to look at it as anything other than witness tampering. how do you view those comments? >> yes. i think it definitely invokes the spirit of prohibitions against witness tampering and obstruction. you know, i'm not sure if that could actually be investigated or charged in that way. that's what he's doing. we've seen this movie before. we saw this in the mueller probe, the dangling of the pardons. and that's when he was a sitting president. i call this the pre-presidential pardon dangling, which is both to give him political benefit. but i think we should also

these were in mar-a-lago for more than 18 months. what could happen if this kind of information fell into the wrong hands? >> well, first of all, it's the duplication that has always made me worried. one of the reasons why you view it in a scif or make it inaccessible to say cameras on iphones is you really do not want people emailing, it xeroxing it, circulating it. so, just the fact that it was sitting around means anyone, including trump, could come along and copy it and then share it with someone else. so, is the copying and duplication that is worrisome. and then of course it's the foreign spiraling and espionage to get their hands on it and now they know something about say another countries nuclear capabilities or limitations. and then the third is, you know, are there exchanges being made for this information? this is what we do not know. this is why. so i think it is. but i want to just really sort of second your point. we're so focused on the picture -- >> right, exactly. >> all this classified information. it's the obstruc

what do you make of these empty folders found at mar-a-lago? any sense of whether trump is still hoarding documents, even now? >> that's, of course, i have no sense -- i wonder if even president trump and his aide know where these documents are, our noses documents are missing. that is the whole point of it, right? there are empty folders that once contained, at least somewhat sensitive information that was supposed to be returned, or it was classified. those folders are empty. it's almost impossible to know, number one, what was in the folders and, number two, where that information is now. it could be that the information was either returned beforehand, just not in the right folder. it could be part of the documents that were seized by the fbi during the search last month, or they could be documents still floating around anywhere. that is the concern. that is the question. that is why there is so -- there are people saying what we are hearing out of mar-a-lago, what the fbi search found is troubling. >> indeed,, that is a big question mark. j

i want to ask you about the mar-a-lago case. sdny has one of the largest national security divisions, most expertise in this kind of case. would you charge donald trump based on the evidence that is public facing. >> it is always frustrating me when i was u.s. attorney for southern district when outsiders would opine on something or add comments when they didn't have any evidence or a sliver of evidence so i'm not going to speculate about that. but what i will say is, what strikes me is the most significant revelation is that the department of justice is investigating donald trump and those around donald trump not just for the mishandling of classified information, but for obstruction of a subpoena requiring the production of that classified information. that is a very, very serious charge and if that were in the southern district of new york, that would have a highest priority and we would be moving on it very, very quickly. and you see that kind of urgency in the filings of merrick garland in this case. the department of justi

all documents remaining at mar-a-lago marked classified. they received then, both an oral assurance from one of trump's lawyers and a written assurance from another lawyer who is acting as the formal custodian of records for the trump office, that all of those documents at mar-a-lago marked as classified had been turned over at that point. that obviously was false. so, that statement was based on the information provided to me, in the writing statement. what they don't know is who told those lawyers this was everything. did those lawyers know that was everything? there's some evidence that before one of them had gone through and gather the documents, some boxes had been removed from the storage area and were not brought back. were they in on something? or where they themselves deceived by someone else? they are very likely to either receive a grand jury subpoenaed themselves, to come testify about what they know or even to be charged for making a false statement which could result in negotiations or, at this point a sealed plea perhaps. and
