. >>> this is cbs news bay area with juliette goodrich. >>> we have a lot to cover tonight. san jose police telling kpix 5 tonight they have arrested a hit-and-run driver accused of plowing into a grandmother who was pushing a child in a stroller. we first showed you this shocking video -- pretty hard to watch. you can see the woman entering a marked crosswalk when a car knocks her in the 3-year-old to the ground. both survived. that was on october 25th. now, police say, two days later, a community member called in a tip about seeing the suspect's car. 20-year-old alexa was later taken into custody and says she admitted she was behind the wheel that day. now, news of the arrest comes just hours after the city reported another pedestrian fatality . it is the 30th in san jose just this year. that is an all-time high for the city with two months left in 2022 . overall, san jose has seen traffic fatalities this year just shy of the all-time record of 60. kpix 5's katie nielsen has more on the latest move to make the city streets safer and why police say they are going to need a

our juliette goodrich talked to him about his battle to overcome the aftermath and the bay area group that helped with his recovery. >> it's incredible. i miss -- you know, i have no words to describe any of it. it feels surreal to be back in kind of all the same areas i was just two years ago. >> reporter: but it's been a journey at just 20 years old, he had the shock of his life. he was at the gym when his arm went numb. and he couldn't walk. he says he had the worst headache of his life. hours later, he was in surgery, he had suffered a stroke. >> i'm probably the first one in my family to have a stroke. and so it was -- definitely a little bit of a freak accident. out of the fact that it occurred. >> reporter: but he worked hard to get where he is now. which is back at uc irvine studying to be a software engineer. his friends can't believe what he's endured. >> i have had to break the news a couple of times. and you know, their reaction is always one of shock. because you know, my speech was not affected. pull the plug. >> reporter: 150 days of intensive therapy at the center for

kpix 5's juliette goodrich joins us from the newsroom to break this down. >> reporter: this really is a race against the clock. interim police chief jennifer lewis is scheduled to be confirmed as the new permanent chief. the misconduct accusations include arrest quotas and racial profiling. they came to light when a fired officer released racist and anti-homeless text messages allegedly from a group text involving other officers. lewis was captain with the alleged misconduct happen. the commission wants to delay her confirmation until there is an investigation into what she knew. >> at the was the case in the chief did happen to know, unbearably , we are going to have to enter the question of what was her response. ideally, the confirmation will be delayed until a full investigation is conducted . as much information as possible is made public. so folks can have an informed opinion. about the chief . the department at large , and whether these allegations have merit. >> reporter: the commission is also asking for a third party investigation . now, interim chief lewis released a statem
