I think it's difficult for them to absolutely verify something because copyright laws are complicated, even if you think the film has clearance things like the musical score may still be in copyright.
Even the makers of the original film can have problems. The Michael Caine film "Billion Dollar Brain" had copyright problems when they tried to release it on video because it used a clip of the Beatles, which meant they needed the Beatles' permission to release the video.
